Consider providing protection for vulnerable groups

On the afternoon of October 31, during a discussion at Group 15 (including the National Assembly Delegation of Phu Tho and Dak Lak provinces) on the draft Law on Cyber ​​Security, some opinions suggested that, in addition to children, the draft Law should be researched and considered to have provisions to protect vulnerable groups (the elderly, people with limited capacity, behavior, etc.).

Add illegal copying of network information to the group of prohibited behaviors

Basically agreeing with the content of the draft Law on Cyber ​​Security (amended), delegates agreed that perfecting the legal framework on cyber security is extremely necessary in the context of increasingly sophisticated and complex threats in cyberspace.

Giving specific comments on the state policy on cyber security in Article 4, National Assembly Deputy Dang Bich Ngoc (Phu Tho) proposed to edit and complete the content in the direction of "prioritizing and having a specific mechanism on resources in building a specialized force to protect cyber security; ensuring highly qualified human resources; improving the capacity of the cyber security force and organizations and individuals participating in cyber security protection; for research and development of science and technology, mobilizing and attracting talented people to protect cyber security".

According to the delegate, this way of presentation ensures completeness, consistency and ease of understanding, and at the same time clearly demonstrates the special priority policy for special tasks, in line with the current urgent requirements in ensuring national security in cyberspace.

In Article 9 on prohibited acts, National Assembly Deputy Dang Bich Ngoc said that the draft Law should regulate these acts according to specific groups of issues, including: groups related to national security; groups related to organizations and individuals; groups related to social order and safety; and groups related to the rights and legitimate interests of agencies, organizations and individuals. Such grouping will help to make regulations clear, easy to look up, easy to apply and avoid the current situation of both redundancy and deficiency.

Also commenting on this content, National Assembly member Nguyen Thi Thu Nguyet (Dak Lak) said that the draft Law should add the act of illegally copying information from the network to the group of prohibited acts. According to the delegate, this is a form of cyber attack but has not been regulated in the draft, while in reality this situation is common, seriously affecting the rights and interests of organizations and individuals.

Adding “cyber self-defense rights” to specialized forces

Commenting on the regulations on preventing and combating child abuse in cyberspace in Article 20, National Assembly member Dang Bich Ngoc emphasized that children are the largest group of social network users but are most vulnerable due to limited awareness. Cyberspace is an open environment with many contents that stimulate curiosity, so if there are no appropriate regulations and preventive measures, it will easily have a negative impact on children's psychology, health and social awareness.

According to the delegate, it is necessary to have a separate provision on children, but the draft should also consider expanding the protected subjects to other vulnerable groups such as the elderly, the disabled, and people with limited capacity to act. These are people who are also vulnerable to online attacks and fraud due to lack of skills and understanding of network safety.

Along with that, National Assembly Deputy Duong Binh Phu (Dak Lak) proposed adding the phrase "knowledge education, skills guidance" to the regulations on responsibilities of agencies, organizations, parents, and guardians towards children, ensuring consistency with the 2015 Law on Children.

Regarding human resources for cybersecurity protection (Article 43), delegate Dang Bich Ngoc suggested that it is necessary to include the group of subjects directly working in cybersecurity protection agencies as the number one group. Because this is the group of subjects that are fully and comprehensively trained and invested in, have experience, qualifications, and are regularly trained and educated. This is also the group of subjects that the State allows to enjoy special preferential policies as stipulated in Article 4 of the draft Law; then, from Clause 2, it is appropriate to stipulate the subjects as in the draft Law.

Also in the discussion session, National Assembly member Nguyen Thi Thu Nguyet (Dak Lak) said that in Article 46 on disseminating knowledge of cyber security, it is necessary to add the responsibility of the Vietnam Fatherland Front in propaganda work, mobilizing the entire population to participate in protecting cyber security. According to the delegate, protecting cyber security is not only the task of state management agencies but requires the participation of the whole society, ensuring sustainability and synchronization.

Faced with increasingly sophisticated cross-border cyber attacks, National Assembly member Duong Binh Phu (Dak Lak) also proposed adding a provision on "cyber self-defense" allowing specialized forces to apply appropriate technical measures to neutralize or isolate sources of attacks that cause serious damage. This is a content that needs to be legalized to ensure a legal basis for protecting national sovereignty in cyberspace, similar to the "self-defense" in the traditional security field.
