During discussions at Group 7 (comprising the National Assembly delegations of Nghe An and Lam Dong provinces) on the afternoon of October 31st, the National Assembly deputies requested that the drafting committee continue to review and refine the regulations of the draft laws in the field of national defense and security, ensuring consistency, feasibility, and suitability to practical implementation.

Review policies and ensure effective cybersecurity.

Commenting on the draft Law on Cybersecurity, National Assembly Deputy Pham Nam Tien ( Lam Dong ) suggested that the drafting agency carefully consider and review policies encouraging the use of domestic cybersecurity products and services, ensuring cautious implementation to avoid creating the risk of unfair competition between domestic and foreign-invested enterprises.

According to the delegates, classifying information system levels as stipulated in the draft is necessary; however, further clarification and supplementation of the results of implementing the Law on Cybersecurity over the past period are needed. Specifically, it is necessary to assess the practical organization of information systems according to different levels, clearly identify which agency, organization, or individual is the system manager at each level, and clarify the scope of application to private organizations and enterprises. Based on that, the regulations should be adjusted and refined to be more comprehensive, synchronized, and feasible.

Regarding critical information systems related to national security, delegates suggested that the drafting agency continue to research, review, and supplement specific areas to ensure completeness and suitability to the requirements of national security protection in the new situation.

According to National Assembly Deputy Tran Thi Thu Hang (Lam Dong), many products and content created using artificial intelligence (AI) are currently appearing on the internet, some of which have a negative impact on society. Therefore, the drafting agency needs to research and supplement regulations or mechanisms for checking and monitoring the use of AI in creating and disseminating products in order to detect and promptly handle violations, contributing to ensuring a safe and healthy online environment.

Regarding regulations on handling violations, delegates noted that the current regulation stating "anyone who commits acts violating the provisions of this law..." is not entirely comprehensive, as the scope of application includes agencies, organizations, and individuals. Therefore, it is proposed that the regulation be revised to be more comprehensive, clearly stating, "Individuals and organizations who commit acts violating the provisions of this law shall be handled according to the nature and severity of the violation as prescribed by law."

Regarding regulations on protecting children in cyberspace, delegates agreed with previous opinions and proposed expanding the scope of protection to vulnerable groups, including women, the elderly, and people with disabilities, as these groups are frequently subjected to abuse, fraud, or defamation in cyberspace. In addition, delegates also suggested reviewing and standardizing the use of concepts such as "malware," "malicious software," and "spyware" to ensure clarity, ease of application, and avoid overlap during implementation.

Standardize regulations on the protection of state secrets.

Regarding the draft Law on Protection of State Secrets (amended), delegates agreed with the content of the draft and considered the amendments necessary to suit the new situation. However, they requested the drafting agency to continue reviewing and ensuring consistency between this law and related laws such as the Archives Law, the Data Law, the Electronic Transactions Law, and other current legal documents.

Regarding the concept of "state secret electronic documents" as stipulated in Clause 6, Article 2, Representative Tran Thi Thu Hang stated that the current wording is unclear. In the context of digital transformation, where the management of confidential documents extends beyond paper to electronic formats, specific regulations are needed regarding criteria, formats, procedures, and technical security requirements to ensure data safety and recovery in case of incidents. The representative also noted that in many localities, technical infrastructure is limited, so specific guidance on backup, recovery, and data security procedures is necessary during implementation.

Regarding the classification of security levels (top secret, secret, secret), some opinions suggested the need for specific quantitative criteria to avoid situations where ordinary documents are also classified as secret, causing expense and complexity in implementation at the grassroots level. At the same time, regarding the duration of state secret protection, opinions agreed on the timeframes of 10, 20, and 30 years, but suggested further clarification for documents classified for permanent preservation under the Archives Law, in order to clearly define the responsibility for declassification and document management after the protection period expires.

In addition, there were suggestions that the drafting agency should issue detailed guidelines for the implementation of the law, ensuring its feasibility, especially for remote and disadvantaged areas where technical infrastructure and resources are still limited.

Ensuring consistency and feasibility.

Regarding the draft law amending and supplementing a number of articles of 10 laws related to security and order, National Assembly Deputy Trinh Thi Tu Anh (Lam Dong) agreed with the policy of strengthening traffic management, including the installation of dashcams. The Deputy argued that this regulation contributes to ensuring traffic safety and serving the work of preventing and combating violations, but its implementation needs to be carefully studied to avoid affecting the privacy rights of citizens.

However, the delegates suggested that the drafting agency clearly define the mechanism for managing and securing data, ensuring that it is only used for monitoring and investigation purposes as prescribed by law.

Regarding the lifespan of vehicle tracking devices, delegates expressed concerns about the mandatory replacement requirement after January 1, 2029. “If the device still meets technical standards and operates stably, it should be allowed to continue use to avoid waste. Therefore, a specific explanation of the technical or management reasons is needed, along with research into flexible solutions that are appropriate to the reality,” the delegate emphasized.

National Assembly Deputy Tran Duc Thuan ( Nghe An ) emphasized that, in recent times, the drafting agency has actively reviewed and resolved many difficulties and obstacles arising during the implementation of laws in the field of security and order. However, there are still some contents that need to be evaluated more thoroughly in order to find appropriate solutions and ensure feasibility when implemented in practice.

Regarding the draft Law on Protection of State Secrets (amended), delegates stated that the drafting agency has resolved many practical difficulties, promptly institutionalized the Party's guidelines, and proposed amendments and additions to some regulations to better suit the management requirements in the new situation. Delegates also suggested that some contents need to be further clarified, such as determining the list, classification levels, and declassification procedures, ensuring specific, clear, and consistent regulations in implementation.

Regarding the draft Law amending and supplementing a number of articles of laws related to security and order, the delegates clearly stated that the goal of the amendments is to further improve the institutional framework, streamline the organizational structure, and enhance the effectiveness of state management.

"The drafting agency's viewpoint is that amendments to the law must stem from practical requirements and clear political grounds; not be merely formal amendments, but aim to perfect the legal system, enhance the effectiveness and efficiency of implementation, contribute to ensuring security and order, and serve socio-economic development," the delegate emphasized.

According to delegate Tran Duc Thuan, in the context of digital transformation, cybersecurity is a particularly important field, closely linked to ensuring national security, information safety, and the interests of the people. Therefore, continuing to improve the legal framework in this field is necessary, contributing to strengthening the legal foundation for sustainable development and international integration.
