Supplementing regulations to ensure honesty in product reviews

On the afternoon of November 3, during a discussion at Group 15 (including the National Assembly Delegation of Phu Tho and Dak Lak provinces) on the draft Law on E-commerce, some opinions suggested that it is necessary to add regulations to ensure honesty in product evaluation, contributing to preventing counterfeit and poor quality goods in the digital market.

Ensuring safety and security on e-commerce platforms

Commenting on the draft Law on E-commerce regarding the responsibilities of owners of e-commerce platforms conducting direct business, National Assembly Deputy Nguyen Van Manh ( Phu Tho ) said: Clause 4, Article 14 of the draft Law stipulates the storage and ensuring the ability to access information and data about goods and services posted on the platform for at least 1 year from the time of posting.

In current practice, Clause 1, Article 26 and Article 27 of Decree 53/2022 of the Government detailing a number of articles of the Law on Cyber ​​Security stipulate the data storage period and the establishment of branches or representative offices of Vietnam doing business in the field of e-commerce as follows: The data storage period starts from when the enterprise receives the request to store data until the end of the minimum storage period requirement of 24 months. Therefore, it is recommended that the drafting committee study, adjust and extend the minimum storage period of information on goods and services posted on e-commerce platforms to 24 months to be consistent with the Law on Cyber ​​Security.

In addition, National Assembly Deputy Thai Quynh Mai Dung (Phu Tho) said that at the Ninth Session, the National Assembly passed many draft laws with provisions related to e-commerce; however, the draft Law on E-commerce has not yet reviewed all relevant provisions to ensure consistency and uniformity. In addition, at this Tenth Session and in the near future, the Government will submit many draft laws with provisions related to e-commerce. Therefore, the drafting agency continues to review the provisions to ensure consistency and synchronization with other laws. In addition, necessary provisions should be added to ensure network security and protect personal data on e-commerce platforms to avoid being exploited by bad guys.

In addition, delegates also proposed to review the layout and redesign the provisions in the draft Law to be clearer, clearly separating which provisions apply generally, which provisions apply only to e-commerce platforms with online ordering functions, which provisions apply specifically to e-commerce contracts executed through automatic contracts and the responsibilities of the parties in concluding contracts in each case.

Maintain censorship responsibility but need flexible regulations

Regarding e-commerce platforms (Section 2, Chapter II), delegate Thai Quynh Mai Dung said that this is a newly adjusted regulation, aiming to meet practical requirements on the need for stricter regulations to prevent tax losses, control counterfeit goods, fake goods, banned goods, poor quality goods, goods of unknown origin, and protect consumer rights in buying and selling activities on these platforms.

However, the provisions in the draft Law need to be further studied and improved, clarifying the relationship with relevant provisions in other laws; at the same time, it is necessary to clearly define the scope of responsibility of each participating entity in each stage of service and goods provision, ensuring transparent and clear information.

Regarding the responsibility of the owner of the intermediary e-commerce platform (Article 15), Clause 4 of the draft Law stipulates the “automatic censorship of information content about goods and services initiated by the seller before displaying”. National Assembly Deputy Le Dao An Xuan (Dak Lak) said that the responsibility for censorship should be maintained but the form needs to be flexibly regulated, because goods and services in the digital environment are very diverse and constantly arising.

The delegate also noted the current widespread situation of many false reviews of counterfeit and fake goods appearing on e-commerce platforms, causing damage to consumers. However, the draft Law has not mentioned this content. Therefore, it is necessary to supplement regulations to ensure honesty in product reviews, contributing to preventing counterfeit and poor quality goods in the digital market.
