It is necessary to clearly define the legal responsibilities of e-commerce platform owners.

On the afternoon of November 3, at Discussion Group No. 16, including National Assembly deputies from Da Nang, Cao Bang and Tuyen Quang provinces, the deputies discussed the Draft Law on amending and supplementing a number of articles of the Law on Statistics; the Draft Law on amending and supplementing a number of articles of the Law on Prices; and the Draft Law on E-commerce.

Speaking at the discussion on the draft Law on E-commerce (amended), delegate Ma Thi Thuy, member of the Provincial Party Committee, Deputy Head of the Provincial Delegation of National Assembly Deputies, basically agreed with the necessity of promulgating the Law to create a synchronous legal framework for digital economic development.

The Deputy Head of the Provincial Delegation of National Assembly Deputies suggested that the concepts of “large digital platforms” and “transaction thresholds” should be more clearly defined because many provisions in the draft refer to specific responsibilities for these platforms but are not specifically regulated, which can easily lead to difficulties in application. At the same time, it is suggested that the Government be assigned to provide detailed regulations, but the law should include basic criteria such as: number of users, revenue in Vietnam, transaction volume or market share.

Regarding the responsibilities of the owner of the e-commerce platform (Article 13): The Deputy Head of the Provincial Delegation of National Assembly Deputies said that it is necessary to research and regulate in the direction that the owner of the e-commerce platform is responsible for: Verifying, storing and publicizing the registration information of sellers operating on the platform; providing tools for consumers to reflect and complain, and being responsible for receiving and handling such reflections; implementing a mechanism for notifying and removing goods, services and content that violate the law when detected or when requested by a competent state agency; ensuring the security of information and personal data of users; storing transaction information according to regulations... At the same time, the Government is assigned to specify in detail the verification of sellers, the mechanism for removing violating information and the storage period of transaction data.

Delegates also suggested redesigning some articles and clauses to ensure logic, ease of understanding and high enforceability. At the same time, it is necessary to clarify the scope of regulation, especially in cross-border trade.

Commenting on the draft Law on E-commerce (amended), delegate Trang A Duong (full-time member of the National Assembly's Ethnic Council ) said that the promulgation of the Law is extremely necessary, in accordance with Resolution No. 66 of the National Assembly, to perfect the legal framework, ensure balance between state management and create favorable conditions for e-commerce activities. The delegate suggested reviewing and adjusting regulations on administrative procedures in accordance with the spirit of reform, avoiding unnecessary barriers for businesses.

Regarding Article 38, developing human resources for e-commerce, it is proposed to amend Clause 3 to expand the scope of support: The State prioritizes allocating resources and budget for e-commerce training in ethnic minority areas, mountainous areas, border areas, islands and areas with difficult socio-economic conditions, while developing a national digital learning platform that provides open online courses on e-commerce. Enterprises investing in human resource training are entitled to tax incentives according to regulations.

Regarding preferential policies and support for e-commerce development, delegates proposed using terminology consistent with Resolution 88, clearly defining the subjects as ethnic minorities, residents in border areas, islands, and particularly difficult areas to ensure correct and accurate policies.

Regarding the development of the e-commerce market, delegates recommended continuing to review regulations on forms of commitment of business entities, avoiding creating barriers for small and medium enterprises, especially start-ups; encouraging innovation, developing flexible business models and ensuring fair competition between domestic and foreign enterprises.

Also in the Group discussion session, delegate Hoang Ngoc Dinh (Member of the Provincial Party Executive Committee, Deputy Commander of the Provincial Military Command, and Commander of the Provincial Border Guard Command) highly agreed with the amendment and supplementation of a number of articles of the Law on Statistics, in order to institutionalize the policies of the Party and State, especially in the context of the need to streamline the state apparatus, organize two-level local governments and strengthen the application of science and technology, and digital transformation.

Regarding the statistical reporting regime, delegates proposed that the Ministry of Finance soon promulgate a statistical reporting regime at the provincial and communal levels, applied uniformly nationwide; without duplication and without increasing the workload of the communal level because this content is implemented by the grassroots statistical agency to ensure uniformity in statistical expertise and operations.

Regarding the national statistical database: The Draft Law has added 01 article (Article 51b. National statistical database), which is an important step in forming a centralized, unified and synchronized statistical data platform. This is a tool to help connect, share and exploit data effectively, serving national digital transformation and policy making. Delegates emphasized that adding a national statistical database will contribute to overcoming the situation of scattered and fragmented data, increasing the ability to integrate and share information, while ensuring transparency, objectivity and the ability to connect, share and integrate data to serve national digital transformation.
