Supplementing regulations on management of e-commerce platforms and data

To ensure the consistency of the draft Law in the legal system, National Assembly Deputy Nguyen Phuong Tuan ( An Giang ) proposed reviewing the provisions of the draft Law with the Law on Electronic Transactions, Law on Credit Institutions, Law on the State Bank of Vietnam, Law on Consumer Rights Protection, Law on Data and draft Laws being submitted to the National Assembly for consideration and approval at the 10th Session such as the draft Law on Cyber Security and the draft Law on Digital Transformation.

Commenting on the application of technology in the management of e-commerce activities (Chapter V), National Assembly Deputy Bui Thi Quynh Tho ( Ha Tinh ) stated that the nature of e-commerce is closely linked to the technology category for operation and management. Is it necessary to name the chapter "Application of technology..."? While Articles 41 and 42 are relatively important in regulating the foundation for managing e-commerce activities and e-commerce databases, only the name of Article 43 coincides with the name of the chapter.

Therefore, the delegates proposed to revise the chapter name to “Management of e-commerce activities” with additional regulations on issues related to management of e-commerce platforms and databases. Only then can the nature of e-commerce activities as well as the spirit of state management of e-commerce activities be demonstrated.
Establish a mechanism for sharing, connecting, and processing information
Regarding the platform for managing e-commerce activities (Article 41), delegate Nguyen Phuong Tuan said that this is a progressive regulation in the management of e-commerce on digital platforms.

However, delegates suggested that it is necessary to clarify the roles and responsibilities of ministries, branches and localities regarding this digital platform for managing e-commerce, especially in "handling complaints and complaints from organizations and individuals about e-commerce platforms, intermediary e-commerce platforms and sellers violating the law" (Point b, Clause 2, Article 41) because it involves many specialized laws and is the responsibility of many agencies and organizations.
Delegates also proposed to study and supplement regulations on the functions of e-commerce management platforms to comprehensively reflect the functions of state management of e-commerce such as: the function of inspecting and supervising the activities of e-commerce platforms; guiding the implementation of legal regulations on e-commerce, etc.

On the other hand, National Assembly Deputy Nguyen Thi Thu Ha (Quang Ninh) suggested that it is necessary to supplement principles in e-commerce activities on coordination and data connection in protecting e-commerce consumers in order to establish a mechanism for sharing, connecting, and processing information between management agencies, trading floors, and service providers. Thereby, improving efficiency and protecting consumer rights.

Delegate Nguyen Thi Thu Ha also suggested that it is necessary to study and supplement regulations to protect the legitimate rights and interests of consumers in e-commerce activities, because this is a core element in this activity.
