Encourage organizations and businesses to participate in strategic reserves

Briefly presenting the Draft Law, Minister of Finance Nguyen Van Thang said that the draft Law consists of 6 chapters and 35 articles (31/66 articles less than the current Law).

On the basis of inheriting some contents on the appropriate scope of the 2012 Law on National Reserves, the draft Law has removed the phrase "formation, management; rights and obligations of agencies, organizations and individuals in national reserve activities" and added the phrase "state management of national reserves" to cover all the contents prescribed in the Law.

Regarding the list of national reserve goods, the Minister said that the draft Law has thoroughly decentralized and delegated authority in the direction of stipulating criteria for the list of national reserve goods to ensure that national reserve goods are strategic, essential goods, frequently used, and effective in responding promptly in sudden and urgent situations; special, irreplaceable; materials, equipment, and goods to ensure national defense and security; and assigned the Government to regulate the list of national reserve goods; ministries and branches managing national reserve goods to specify details of national reserve goods.

According to the Summary Report on the preliminary examination of the Law project presented by Chairman of the Economic and Financial Committee Phan Van Mai, the majority of opinions in the Standing Committee of the Economic and Financial Committee agreed with the proposal to submit to the National Assembly Standing Committee for consideration of including the Law project in the 2025 Law-making Program and submit it to the National Assembly at the 10th Session according to the shortened order and procedures.

Chairman of the Economic and Financial Committee Phan Van Mai presented a summary report on the preliminary review of the draft Law on National Reserves (amended).

Regarding the list of national reserve goods, some opinions say that the list of national reserve goods is an important content of the Law on National Reserves. Therefore, it is recommended to stipulate the list of reserve goods groups in the Law and assign the Government to specify the goods in detail according to the groups of goods stipulated in the Law.

Regarding the socialization of national reserves, the Chairman of the Economic and Financial Committee stated that the draft Law has made important progress in promoting the socialization of national reserve activities, contributing to diversifying resources, improving the flexibility of national reserves and reducing the burden on the state budget.

However, the provisions of the Draft Law are still principled, mainly emphasizing "encouragement" and "facilitation" without any specific binding mechanism. Therefore, the Standing Committee of the Committee recommends that it is necessary to study and supplement policies to encourage organizations and enterprises to participate in strategic reserves such as preferential policies on tax, finance, credit, mechanisms for repurchasing and rotating strategic reserves, etc.

Concluding the discussion, Vice Chairman of the National Assembly Nguyen Duc Hai stated that the National Assembly Standing Committee highly appreciated the preparation process of the draft Law and the review process of the Economic and Financial Committee.

To ensure the quality of the draft Law, the Vice Chairman of the National Assembly requested the Government to fully absorb the opinions of the National Assembly Standing Committee and the examining agency. In particular, it is noted that it is necessary to continue reviewing to ensure full institutionalization of the Party's policies; emphasizing that national reserves not only serve the purpose of relief in emergency situations but also truly become strategic reserves, serving as a tool to regulate the market to ensure the economy operates stably and effectively according to market rules and socialist orientation, and is one of the important pillars of national security, economic security and sustainable development.

The Vice Chairman of the National Assembly stated that amending the law must resolve current difficulties and problems, and at the same time, fundamentally change the thinking on national reserves according to the Party's policy, in line with development goals in the new situation; especially issues on strategic reserves, socialization of national reserves, reserves to regulate the market...

At the same time, review the regulations on law application and enforcement provisions to ensure feasibility and no problems when applying; study regulations that take effect earlier to ensure timely resolution of urgent requirements when amending the Law.

The Vice Chairman of the National Assembly proposed that the Government direct the drafting agency and relevant agencies to study and absorb the opinions of the National Assembly Standing Committee to complete the draft Law dossier. The Economic and Financial Committee will officially review and submit it to the National Assembly for consideration and decision.
