Need to link price management between commune and provincial levels

On the afternoon of November 3, during a discussion at Group 12 (including the National Assembly Delegation of Dong Thap and Quang Ngai provinces) on the draft Law amending and supplementing a number of articles of the Law on Prices, many delegates proposed to study the mechanism of authorization or interconnection of price management between the commune and provincial levels.

Carefully evaluate the conditions for ensuring implementation at the commune level.

Discussing the draft Law amending and supplementing a number of articles of the Law on Prices, National Assembly Deputy Pham Van Hoa ( Dong Thap ) stated that stabilizing prices of essential goods and goods serving people's lives is very necessary. Therefore, the Government needs to clearly and specifically define which goods have stable prices (such as food and essential foodstuffs).

Delegates also agreed with the regulations, assigning the responsibility of the People's Committees at the provincial and communal levels to coordinate with ministries and branches to organize the implementation of price stabilization. In particular, clarifying the responsibility of local authorities to stabilize prices of essential goods to serve people's needs.

Also paying attention to price stabilization, National Assembly Deputy Tran Thi Hong An ( Quang Ngai ) noted that the draft Law has amended Clause 3, Article 1 in the direction of "replacing the phrase District People's Committee to Commune People's Committee". However, to avoid overload at the Commune People's Committee, it is necessary to study the mechanism of authorization or price management linkage between the commune and provincial levels; at the same time, supplement specific guidance on the responsibility of coordination between relevant departments and branches at the provincial and commune levels in organizing price stabilization.

Delegate Tran Thi Hong An cited that, according to the Law on Organization of Local Government, the People's Committee at the commune level had to perform 9 groups of tasks and powers as prescribed, 3 groups of tasks were decentralized, transferring power from the Central level, to the Provincial People's Committee, the Provincial Chairman, as well as the group of tasks and powers transferred from the District People's Committee. "The workload is already very large, if the People's Committee at the commune level is assigned to be responsible for price stabilization, it would be too heavy and unfeasible."

Considering that the amendment and replacement of the phrase "District-level People's Committee" with "Commune-level People's Committee" at Point b, Clause 2, Article 20 of the draft Law is to ensure conformity with the 2-level local government organization model, strengthening decentralization and delegation of power to commune-level governments, however, National Assembly Deputy Luong Van Hung (Quang Ngai) also requested to carefully study and evaluate the conditions for ensuring implementation of the Commune-level People's Committee, especially in the current conditions of inadequate capacity, professional qualifications of the staff, civil servants and support resources for the commune level.

"The decentralization and assignment of additional price management authority to the People's Committees at the commune level needs to be regulated in a synchronous manner with the mechanism of professional guidance, training, fostering, and inspection and supervision of implementation, in order to avoid task overload, overlap or inconsistent implementation among localities," the delegate suggested.

Using price tools to encourage people to sort waste at source

The Draft Law stipulates: “Public products and services (public career services and public utility products and services) using the state budget from regular expenditure sources under the ordering authority of local agencies and organizations will have specific prices determined by the People's Committee of the province.”

Delegate Luong Van Hung affirmed that this regulation is consistent with the principle of decentralization and delegation of power in state management, ensuring the proactive role of local authorities in determining prices of public products and services using the state budget.

However, to enhance publicity, transparency and ensure harmony of interests between the State, suppliers and beneficiaries, delegates proposed to add a monitoring and social consultation mechanism in the process of the Provincial People's Committee deciding on specific prices for essential public services in the area such as: collection, transportation and treatment of domestic solid waste...

Along with that, adding regulations on consulting opinions of the Vietnam Fatherland Front Committee and local socio -political organizations will contribute to ensuring social consensus, promptly reflecting people's opinions and aspirations, thereby helping the public service price policy to be truly fair, reasonable and feasible.

The draft Law stipulates the abolition of a number of phrases related to the conditions for establishing a valuation enterprise and the conditions for appraisers to register to practice at the enterprise. Delegate Luong Van Hung commented that this is a positive adjustment, consistent with the policy of reforming administrative procedures, cutting unnecessary business conditions, creating a more favorable environment for enterprises operating in the valuation field.

“The abolition of the above conditions still ensures the consistency of the legal system, because related contents have been stipulated in other specialized laws such as the Enterprise Law and implementing documents,” the delegate emphasized.

The delegate also requested the drafting agency to continue reviewing to ensure that there are no legal gaps or overlaps in state management of practice conditions, in order to both encourage the development of the valuation service market and maintain professional standards, professional ethics and service quality.

The draft Law stipulates that the Provincial People's Committee shall determine specific prices for households and individuals using the collection, transportation and treatment services of domestic solid waste.

Delegate Luong Van Hung proposed to add the principle of pricing that must comply with the principle of charging according to the mass or volume of domestic solid waste generated according to the provisions of the Law on Environmental Protection 2020, contributing to synchronizing the legal system and using price tools to encourage people to classify waste at source, minimize waste, thereby realizing the policy of "polluters must pay" and enhancing community responsibility.
