Strongly cutting administrative procedures that make investors hesitant

(Dan Tri) - Pointing to the fact that there are still many administrative procedures that increase costs and time for people and businesses, many National Assembly delegates strongly proposed cutting and simplifying procedures in business investment.

The Resolution on the 2026 Socio -Economic Development Plan recently passed by the National Assembly at its 10th session clearly stated the double-digit growth target and one of the tasks and solutions to realize that target is to promote the reduction and simplification of administrative procedures and improve the investment and business environment.

Accordingly, the National Assembly requires resolutely cutting and simplifying administrative procedures and business regulations, not allowing the emergence of new procedures, business regulations, standards, norms, and techniques that are inappropriate and lacking feasibility.

In 2026, the task assigned by the National Assembly is to cut and simplify 100% of unnecessary or contradictory, overlapping investment and business conditions or general, non-specific and unclear regulations; abolish 100% of investment and business conditions of industries and professions not on the list of conditional investment and business industries and professions of the Investment Law; cut 50% of the time to handle administrative procedures and 50% of the cost of complying with administrative procedures compared to 2024.

Discussing in groups about the revised Investment Law project at the 10th session, many National Assembly deputies also mentioned this issue.

Delegate Le Dao An Xuan ( Dak Lak ) emphasized the need to remove difficulties and obstacles in legal institutions as well as reduce and simplify administrative procedures in business investment, creating favorable conditions for people and businesses to exercise their rights.

She noted the progress when the law stipulates that if investing in industrial parks, export processing zones, high-tech zones, concentrated digital technology zones, free trade zones, international financial centers, etc., special investment procedures will be applied, reducing all types of procedures from environmental impact assessment reports, fire prevention and fighting, technology appraisal, construction permits, etc. to go straight to project construction.

“This is a huge step to create conditions to attract investment into these special areas,” said Ms. Xuan.

Delegate Trinh Lam Sinh (An Giang) commented that the fact that there are still many administrative procedures is what makes investors very hesitant and afraid, because the time for procedures is long, causing time to drag on, sometimes requiring the use of "special tools" to quickly resolve documents.

Land procedures, according to delegate Sinh, are also what makes large and small investors hesitant, or the change of land use purpose, transfer or reinvestment still has many risks, because the procedures are very complicated. Therefore, the delegate proposed to review and simplify the entire legal framework so that the procedures are simple, concise and transparent.

Commenting on conditional business lines, delegate Nguyen Van Quan (Can Tho City) suggested that the Government should announce business conditions and investment conditions so that businesses only need to register and make a commitment to send to the competent authority, without having to ask for permission or license.

According to Mr. Quan, this will eliminate the request-grant mechanism; reduce administrative procedures, and importantly, reduce costs and time for people and businesses, while increasing post-inspection by specialized agencies and state management agencies.

“In reality, recently, granting business eligibility certificates took a lot of time and the input was very strict, but during the production and business process, some businesses did not comply with and did not follow the license, and did not follow the standards that were granted,” Mr. Quan stated the reality.

Delegates proposed to strengthen post-inspection, enterprises only need to notify, meet and commit to enough standards and conditions to be able to operate, and state agencies only need to post-inspecte.

Providing more information on conditional investment and business sectors, Finance Minister Nguyen Van Thang said that the State management agency has reviewed, screened and identified investment and business sectors that really need to be pre-inspected and switched to a post-inspection mechanism, while cutting down on some unnecessary and unreasonable sectors.

He said the draft has reviewed and cut down about 25 conditional investment and business sectors and the drafting agency will continue to review, cut down and reduce the list of conditional business sectors to the maximum.

"This is an issue that people have been very concerned about for a long time. Now we must continue to review and strongly cut and reduce this list," Mr. Thang emphasized that this is a necessary thing to do.

Resolutely cut out unnecessary procedures that people still have to do.

Administrative procedure reform is also an issue that the Government and the Prime Minister have strongly emphasized since the beginning of their term.

In early October, the Prime Minister announced that he had approved a plan to reduce and simplify administrative procedures and business conditions under the management of 14 ministries and ministerial-level agencies. Accordingly, 2,051/4,888 administrative procedures are expected to be reduced and simplified; 2,263/6,974 business conditions are expected to be reduced; and 466 legal documents are expected to be amended and supplemented.

Regarding localities, 25/34 provinces and centrally run cities have integrated and provided online public services with administrative procedures related to enterprises on the National Public Service Portal, of which 4 localities have reached 100%. 34/34 localities have published a list of administrative procedures regardless of administrative boundaries in the area.

However, according to reports from ministries, localities and data synthesis on the National Public Service Portal, there are a total of 668 specific administrative procedures of localities, in which some localities have an increased number of specific administrative procedures.

The rate of administrative procedures related to enterprises provided online by ministries is generally low (8 ministries have a rate of less than 50%); the list of administrative procedures not depending on the administrative boundaries of the provinces mostly only reaches 50%-95%, of which some localities only reach less than 10%. In addition, the business community continues to reflect that there are still some cumbersome administrative procedures, unnecessary business conditions, and prolonged time to enter the market....

Minister and Head of the Government Office Tran Van Son, in a meeting in early November, also emphasized that administrative procedure reform is not just about cutting paperwork, but also about innovating service thinking, moving towards a modern, transparent, digitalized administration that serves people and businesses.

He said that in Resolution No. 66 on the Program to reduce and simplify administrative procedures related to production and business activities in 2025 and 2026, the Government set a target of reducing at least 30% of procedure processing time, 30% of compliance costs and 30% of business conditions by 2025; by the end of the year, 100% of administrative procedures related to enterprises must be done online.

In a meeting on the morning of November 15, Prime Minister Pham Minh Chinh recounted a story he encountered in Thanh Hoa, when a parent had to travel 19km to the commune People's Committee headquarters to get a birth certificate for his student child, then send it to Hanoi.

Informing that he has guided people to access the VNeID application, which contains complete data on family relationships as well as information on each person's date of birth and place of birth, the Prime Minister emphasized the need to definitely cut out unnecessary procedures that people still have to do.
