For a long time, there has been a situation where some units that manage and use customers' personal data have leaked information to third parties, causing many people to be bothered, or worse, lose money, or even have legal problems. Therefore, according to regulations, when providing services, service providers require users to provide personal information, but many people have hesitated or refused to provide it because of fear, leading to them being unable to use the service.

Recently, the Government issued Decree No. 13/2023/ND-CP on personal data protection, effective from July 1, 2023. The issuance of a separate decree on personal data protection is very necessary and suitable to the current situation, to enhance the responsibility of relevant parties. Accordingly, the decree not only prohibits the buying and selling of personal data in any form, but also specifies the responsibilities of subjects and organizations related to personal data, including data subjects, data controllers, data processors and third parties related to the data. With these provisions, the decree has created a legal corridor for State management agencies to review, evaluate, inspect and examine compliance with personal data protection regulations with organizations and units that collect, control and process data, instead of many people expressing concern that their data could be leaked at any time. At the same time, with the requirement to increase the responsibility of users themselves, users will be required to be more proactive in protecting their personal data, as well as participating in detecting and requesting other organizations and individuals to protect personal data related to them. Accordingly, users can request units and organizations to access, view, edit and delete information related to them. This is something that almost no service providers previously agreed to.

The Decree can be said to have met the people's wishes, but the people themselves must be aware of their personal responsibilities in order to best protect their rights together with the authorities. From now until the Decree takes effect, the authorities need to step up propaganda, provide specific instructions for people to know and follow in order to create a habit of contributing to early detection of violations in the management and use of personal data. Only then can we avoid missing or letting violations in the management and use of personal data slip through, and plug the loopholes that are causing much social outrage today.
