La Vie mineral water fined, collected over 66 billion VND in tax

ANTD.VN - La Vie Company Limited was charged 66.6 billion VND after a tax inspection, including corporate income tax, resource tax, and environmental protection fees.

The Long An Provincial Tax Department has just issued the Conclusion of a tax inspection at La Vie Company Limited (La Vie). Accordingly, La Vie was found to have committed violations in tax law compliance.

La Vie was ordered to pay back taxes and fined for tax violations.

Specifically, regarding corporate income tax (CIT), the Long An Tax Department stated that La Vie had not adjusted the provisions for inventory devaluation expenses in accordance with the Ministry of Finance 's guidelines. Due to this violation, La Vie was ordered to pay back nearly 3.4 billion VND in CIT for the years 2016 to 2020.

Regarding resource tax, the Tax Department said that La Vie's determination of resource tax incentives was not in accordance with the provisions of the Law on Resource Tax. In addition, the company also declared the taxable resource output not in accordance with the guidance of the Ministry of Finance.

Due to this violation, the Tax authorities determined that La Vie is required to pay back over 61.5 billion VND in resource tax for the period from 2016 to 2020.

In addition, regarding environmental protection fees, La Vie determined that the fee level and the resource output for which the fee was calculated were incorrect. Therefore, this enterprise was charged an additional 1.7 billion VND after the inspection.

Thus, after the inspection, the total amount of tax and fees collected from La Vie is 66.6 billion VND. Along with that, the Tax Department requested La Vie to adjust the amount of corporate income tax payable in 2017 down by 485 million VND.

Regarding administrative sanctions, according to the inspection conclusion, some of La Vie's violations in the tax periods of 2016 and 2017 have expired.

For tax periods from 2018 to 2020, the statute of limitations for penalties was recalculated from the date the inspection report was signed. The reason, according to the Tax Authority, is that La Vie repeatedly delayed signing the inspection report. The inspection team contacted the company several times, but the company stated it needed to seek opinions from competent authorities and therefore requested an extension. The Tax Authority applied monetary penalties in accordance with current regulations.

La Vie Company Limited was established and operated since September 1992, its actual business line is the production of natural mineral water and bottled drinking water.

Currently, the company has its headquarters in Tan An City, Long An Province, and three branches in Ho Chi Minh City, Hanoi , and Hung Yen Province.
