Decentralize vehicle inspection management, increase sanctions for violations

The Ministry of Transport has just issued Official Dispatch No. 10407/BGTVT-KHCN&MT to the National Assembly delegation of Hanoi City in response to the petition sent by Hanoi voters after the 5th Session of the 15th National Assembly.

Accordingly, voters of Hanoi City requested the Ministry of Transport to inform them whether the 6-month extension for some vehicles in the list of motor vehicle inspections prescribed in Circular No. 08/2023/TT-BGTVT dated June 2, 2023 is really safe for traffic participation. The Ministry of Transport is requested to urgently develop mechanisms, policies and regulations of the industry so that the Inspection Centers can soon operate stably, contributing to ensuring traffic safety nationwide.

Regarding the above-mentioned voters' petition, the Ministry of Transport said that at the end of 2022 and the beginning of 2023, the Ministry of Transport received many petitions from associations, businesses and people requesting to extend the inspection cycle for passenger cars with up to 9 seats, not for business transportation.

In response to the recommendations, the Ministry of Transport has urgently reviewed current regulations on motor vehicle inspection and reported to the Prime Minister for permission to issue two circulars amending and supplementing Circular No. 16/2021/TT-BGTVT dated August 12, 2021 of the Ministry of Transport regulating the inspection of technical safety and environmental protection of road motor vehicles according to simplified procedures.

In fact, Circular No. 08/2023/TT-BGTVT dated June 2, 2023 only allows immediate application of the inspection cycle as prescribed in Circular No. 02/2023/TTBGTVT dated March 22, 2023 for passenger cars with up to 9 seats, not for transportation business, specifically:

Circular No. 02/2023/TT-BGTVT has adjusted the inspection cycle of the above group of vehicles by 6 months compared to Circular No. 16/2021/TT-BGTVT without changing the standards for inspection, assessment of technical safety and environmental protection of vehicles compared to previous regulations;

Only vehicles that have been inspected for technical safety and environmental protection and have been granted a Certificate and Inspection Stamp before March 22, 2023 (the effective date of Circular No. 02/2023/TT-BGTVT) will be subject to an additional 6 months of inspection according to the inspection cycle prescribed in Circular No. 02/2023/TT-BGTVT.

These vehicles have been inspected, evaluated, and have the same procedures, content, and inspection items as the vehicles currently inspected and granted Technical Safety and Environmental Protection Certificates.

The amendment and supplement of the regulations on the inspection cycle for the group of passenger cars with up to 9 seats, not used for transportation business mentioned above, is built on the basis of statistics, evaluation of inspection results in recent years and updating experience in regulating international inspection cycles, contributing to reducing social costs, creating favorable conditions for people and businesses in the inspection process.

In addition, this is a group of privately owned cars, the frequency of use is not much compared to vehicles used for transportation business, is a valuable asset of the people, has a direct impact on the health and life of the vehicle owner and his family and relatives, so they are often better cared for, maintained and repaired than vehicles used for transportation business.

Regarding the content "Requesting the Ministry of Transport to urgently develop mechanisms, policies and regulations of the industry so that the Inspection Centers can soon operate stably, contributing to ensuring traffic safety nationwide", in order to consolidate, improve and innovate the activities of the motor vehicle inspection sector, implementing the direction of the Prime Minister, the Ministry of Transport has urgently coordinated with relevant ministries and branches to research, review, develop and submit to the Government for promulgation Decree No. 30/2023/ND-CP dated June 8, 2023 amending and supplementing a number of articles of Decree No. 139/2018/ND-CP dated October 8, 2018 of the Government regulating the business of motor vehicle inspection services; Issued 2 Circulars amending and supplementing a number of articles of Circular No. 16/2021/TT-BGTVT dated August 12, 2021 of the Minister of Transport regulating technical safety and environmental protection inspection of road motor vehicles.

The above-mentioned legal documents have been issued with stricter regulations on a number of contents to enhance the effectiveness and efficiency of state management, improve quality and ensure transparency in motor vehicle inspection.

Specifically, more strictly manage the licensing of inspection units, accordingly the construction and establishment of inspection units must be consistent with local planning; consistent with the number and density of vehicles in the area; consistent with the traffic system connection; convenient for motor vehicles to enter and exit for inspection and not cause traffic congestion, especially in large cities;

Clear and transparent decentralization of state management responsibilities at central and local levels in licensing and managing inspection units and inspectors, in which the Department of Transport shall issue Certificates of eligibility for motor vehicle inspection activities of inspection units in the area; the Vietnam Register shall carry out specialized professional management and be responsible for issuing Inspector Certificates nationwide;

More clearly regulate the inspection and examination work, accordingly, the Department of Transport is responsible for inspection and examination at the local level, the Vietnam Register is responsible for specialized inspection nationwide; Stricter and clearer regulations on the organizational structure and human resources of the inspection unit; clarify the responsibilities of the unit's leaders, heads of the inspection department, inspectors, professional staff, etc.;

Supplementing sanctions against inspection units, inspectors and employees for acts of arbitrarily making requests or issuing procedures not specified in regulations, refusing to provide inspection services... causing difficulties for businesses and people; Increasing sanctions for violations of inspection units and inspectors to increase deterrence. Increasing the responsibility of inspection units and binding the responsibility of the organization establishing the inspection unit if violations occur; Building a new synchronous inspection management software system towards managing and monitoring vehicle inspection work in real time (online), increasing security and limiting negative interventions on inspection results during the vehicle inspection process;

The Ministry has coordinated with the Ministry of Finance to report to the Government and propose to the National Assembly to amend and supplement the Law on Prices, including proposing to adjust regulations on prices for motor vehicle inspection services to suit current reality to ensure income for inspection units and employees, and limit negativity.
