On the afternoon of June 1st, the Government Office held its regular press conference. At the press conference, reporters questioned representatives from the Ministry of Finance about the recent series of live-streamed sales events generating billions of dong in revenue. "Could you please explain how tax evasion is being managed in relation to these live-streamed sales events?" the press asked.

Responding to this issue, Deputy Minister of Finance Nguyen Duc Chi stated that when conducting livestream sales online – meaning this activity generates revenue – it can generate income.

"Once revenue and income are generated, they are subject to the regulations of tax laws and levies, as well as the management and supervision of the tax authorities," Mr. Chi said.

According to Mr. Chi, for e-commerce activities in general, or livestreaming sales online in particular, the Ministry of Finance has implemented management and supervision under two tax regulations.

For individuals, if revenue and income are generated, they are subject to income tax, as regulated by the Personal Income Tax Law. "We manage and collect taxes on this activity in accordance with the Personal Income Tax Law," Mr. Chi stated.

If a household business engages in e-commerce or livestreaming activities that generate revenue (referred to as commission), then it is managed and taxed according to regulations related to the management of household businesses (either through a lump-sum tax system or tax declaration).

Deputy Minister of Finance Nguyen Duc Chi answered questions at the press conference.

Deputy Minister Nguyen Duc Chi stated that e-commerce and livestreaming sales are activities that have emerged during the development of information technology. Over the past period, the tax authorities have focused on communicating with all participants in these activities to ensure they understand tax regulations.

From there, they voluntarily declare and pay taxes in accordance with the law. In addition, the tax authorities also monitor and inspect this activity for individuals and household businesses.

Mr. Chi stated that, through strengthening tax management for e-commerce activities, the tax sector has achieved many positive results in tax management for e-commerce activities, including tax management for livestreaming sales.

Specifically, tax management data for the last two years has recorded tax collection results from organizations and individuals engaged in e-commerce business activities. Accordingly, in 2022, tax management revenue was 3.1 trillion VND (130.57 billion USD), with taxes paid amounting to 83,000 billion VND. In 2023, tax management revenue was 3.5 trillion VND (146.28 billion USD), with taxes paid amounting to 97,000 billion VND.

Furthermore, the cumulative inspection and violation handling results over the three years (2021, 2022, and 2023) show that a total of 31,570 e-commerce businesses and individuals were subject to review (6,257 enterprises and 25,313 individuals). Of these, a total of 22,159 businesses (543 enterprises and 21,616 individuals) were processed for tax declaration, payment, tax collection, and violation handling, resulting in an additional tax revenue of 2,900 billion VND .
