
The 2025 Employment Law takes effect from January 1, 2026, regulating the level, duration, and timing of unemployment benefits.
Accordingly, the monthly unemployment benefit is equal to 60% of the average monthly salary for unemployment insurance contributions of the 6 most recent months of unemployment insurance contributions before the termination of the labor contract, work contract or termination of employment, but not exceeding 5 times the regional minimum monthly salary announced by the Government applied in the last month of unemployment insurance contributions.
The period of unemployment benefits is calculated based on the number of months of unemployment insurance contributions. For every 12 months of contributions up to 36 months, you will receive 03 months of unemployment benefits. After that, for every additional 12 months of contributions, you will receive 01 more month of unemployment benefits, but the maximum period of unemployment benefits is 12 months.
The time to receive unemployment benefits is the 11th working day from the date of submitting complete unemployment benefits application.
Employees receiving unemployment benefits are entitled to health insurance benefits in accordance with the provisions of the law on health insurance, including the period of suspension of unemployment benefits as prescribed in Clause 2, Article 41 of this Law. Employees receiving unemployment benefits have their health insurance premiums paid by the social insurance agency from the Unemployment Insurance Fund.
During the period of receiving unemployment benefits, every month, employees must notify the public employment service organization where they are receiving unemployment benefits about their job search.
Thus, compared to the current regulations in the 2013 Employment Law, the 2025 Employment Law retains the formula for calculating unemployment benefits but has added a maximum benefit ceiling and re-regulated the duration of unemployment benefits.
