The Ministry of Science and Technology is drafting a Decree detailing and guiding a number of articles of the Law on Science, Technology and Innovation on innovation; encouraging scientific, technological and innovation activities in enterprises; recognizing innovation centers, supporting creative startups; recognizing individuals and creative startups; infrastructure, networks and ecosystems for creative startups.

In recent years, the national innovation system and creative startup ecosystem have achieved many positive results, making important contributions to socio-economic growth. Many innovation centers, investment funds, and startup support programs have been established, connecting domestic and foreign resources.

However, this activity has not yet fully exploited its potential. Many policies are still scattered and lack uniformity; criteria for identifying and recognizing organizations, individuals and businesses in the ecosystem are unclear; coordination between management agencies is still overlapping. Practice requires a transparent and unified legal corridor to promote innovation as a key driving force for development.

The draft Decree focuses on guiding regulations related to 5 contents.

Firstly, identify and classify types of innovation tasks, innovation programs, and innovation activities in enterprises.

Second, encourage and promote innovation activities in enterprises.

Third, regulations on criteria for identifying and recognizing organizations and individuals that innovate, support innovation, creative startups, innovation centers, creative startup support centers, and certify science and technology enterprises.

Fourth, develop an innovation system, a creative startup ecosystem, promote a culture of innovation and creative startups; improve infrastructure and networks.

Fifth, clearly assign state management responsibilities for innovation and creative startups.

An important highlight is the concretization of regulations on recognition of innovative organizations and individuals and support for startups. The draft Decree sets out principles, procedures, and recognition authority; regulations on the advisory council for evaluating dossiers; and mechanisms for granting, extending, re-granting, and revoking certificates of recognition.

Recognition not only helps to clarify and standardize the subjects in the ecosystem, but also serves as a basis for individuals and businesses to enjoy incentives and support from the State, thereby encouraging deeper participation.

Another focus of the Decree is to improve regulations on science and technology enterprises. After many years of implementing Decree 13/2019/ND-CP, practice shows that there are still many shortcomings.

The recognition criteria are still limited, mainly based on revenue from science and technology products, not reflecting research and development (R&D) and innovation capacity. The reporting mechanism is not effective, lacking tools to check and monitor business activities. Credit incentives, land rent exemption and reduction, investment support... are still fragmented, lacking specific instructions, making it difficult for businesses to access.

The new draft Decree will fully institutionalize the provisions of Law 2025, creating a synchronous and transparent legal corridor, aiming at:

Firstly, simplify procedures, strongly shift from pre-control to post-control, and apply digital technology in management.

Second , decentralization to localities. Provincial People's Committees are empowered to receive, appraise and grant Certificates of Science and Technology Enterprises.

Third, add new recognition criteria. In addition to revenue, consider scale, research capacity, and innovation.

Fourth, synthesize preferential support policies. Clearly stipulate conditions and procedures for accessing incentives on tax, land, credit, and human resource training.

Thereby, the new policy not only increases the quantity but also improves the quality of science and technology enterprises, helping to form a force of enterprises leading national innovation.
