Amending a series of decrees and circulars to simplify aviation administrative procedures

The Civil Aviation Authority of Vietnam has just issued a Program for drafting legal documents that need to be amended and supplemented to implement the plan to reduce and simplify administrative procedures approved by the Prime Minister and the Minister of Construction.

According to the program, the Civil Aviation Authority of Vietnam presides over the development and amendment of a series of Government decrees, including: Decree No. 30/2013/ND-CP dated April 8, 2013 on air transport business and general aviation activities; Decree No. 96/2021/ND-CP dated November 2, 2021 on ensuring flights of special aircraft and special compartments; Decree No. 125/2015/ND-CP dated December 4, 2015 detailing the management of flight operations; Decree No. 05/2021/ND-CP dated January 25, 2021 on management and exploitation of airports; Decree No. 92/2016/ND-CP dated July 1, 2016 regulating conditional business lines and occupations in the field of civil aviation, along with related amended and supplemented decrees.

The drafting of legal documents needs to be revised and supplemented to implement the plan to reduce and simplify administrative procedures.

Along with that, the Department will also preside over the revision of many specialized circulars, including: Circular amending and supplementing a number of articles of Circular No. 19/2017/TT-BGTVT on management and assurance of flight operations; Circular No. 10/2018/TT-BGTVT on aviation staff, training, coaching and testing of aviation staff; Circular No. 01/2011/TT-BGTVT dated January 27, 2011 on the Aviation Regulations; Circular No. 29/2021/TT-BGTVT dated November 30, 2021 on management and exploitation of airports, and related amended and supplemented circulars.

Director of the Civil Aviation Authority of Vietnam Uong Viet Dung said that the agency has requested its departments and units to preside over the drafting, take responsibility for the content, quality and progress of drafting legal documents in the assigned fields. The drafting must comply with the Law on Promulgation of Legal Documents and documents guiding their implementation, ensuring consistency, synchronization, feasibility and suitability to practice. The Legal Affairs - International Cooperation Department of the Authority is assigned to be the focal point for synthesizing and controlling the content of amended and supplemented documents, ensuring compliance with the requirements of the Ministry of Construction ; at the same time, review administrative procedures that still have paper records to convert to electronic form according to the provisions of the draft document.

Previously, Minister of Construction Tran Hong Minh signed Decision No. 1781/QD-BXD promulgating the Program for drafting legal documents that need to be amended and supplemented to implement the plan to reduce and simplify administrative procedures in the fields under the Ministry's management. According to the Appendix issued with the Decision, the draft Decree amending and supplementing a number of articles of the decrees to implement the plan to reduce and simplify administrative procedures related to production and business activities under the management of the Ministry of Construction will be drafted according to shortened procedures and procedures, expected to be sent to the Ministry of Justice for appraisal in November and submitted to the Government in December 2025. For the amended and supplemented circulars, the Ministry of Construction assigned the drafting agencies to send them to the Legal Department for appraisal in November and submit them to the Minister for approval in December 2025.
