Quang Nam Provincial Inspectorate holds dialogue to resolve complaints about compensation and resettlement

According to the case file, authorized by her husband, Mr. Vo Vinh Quang, Ms. Nguyen Dinh Le Thuy (residing at No. 01, Lot C2, Apartment 319 Ly Thuong Kiet, Ward 15, District 11, Ho Chi Minh City) complained about Decision No. 933 dated July 29, 2024 on approving the support and resettlement plan and Decision No. 1096 dated July 31, 2024 of the People's Committee of Que Son district on supporting and resettling the household of Ms. Le Thi Mieng (deceased, represented by Mr. Vo Vinh Quang - son), whose residential land was subject to recovery to build infrastructure for Dong Que Son Industrial Park (Huong An town, Que Son).

Ms. Nguyen Dinh Le Thuy filed a complaint requesting the cancellation of Decision No. 933 and Decision No. 1096 of the People's Committee of Que Son district and implementing Decision No. 1865 dated July 13, 2020 of the Chairman of the People's Committee of Quang Nam province on the settlement of the complaint (second time) of Mr. Vo Vinh Quang and Decision No. 1793 of the People's Committee of Que Son district on the approval of the compensation, support and resettlement plan to calculate the land price for resettlement for Ms. Le Thi Mieng's household.

The complaint of Ms. Nguyen Dinh Le Thuy was first resolved by the Chairman of the People's Committee of Que Son district in Decision No. 1349 dated September 24, 2024, with the content of not recognizing her complaint. Accordingly, Ms. Nguyen Dinh Le Thuy continued to complain to the Chairman of the People's Committee of Quang Nam province.

Regarding the initial complaint settlement, according to the verification results of the Provincial Inspectorate, the Chairman of the People's Committee of Que Son district did not recognize the complaint content of Ms. Nguyen Dinh Le Thuy, on the basis: The People's Committee of Que Son district issued Decision No. 933 dated July 29, 2024 and Decision No. 1096 dated July 31, 2024 to ensure the provisions of the law.

At the same time, analyze the legal basis for the People's Committee of Que Son district to issue Decision No. 1096 dated July 31, 2024 on support and resettlement for Ms. Le Thi Mieng's household. As well as the order and procedures for support and resettlement for Ms. Le Thi Mieng's household.

Therefore, it is considered that Ms. Nguyen Dinh Le Thuy's complaint against Decision No. 1096/QD-UBND dated July 31, 2024 of the People's Committee of Que Son district has no basis for consideration and resolution. Decision No. 1349 dated July 17, 2024 of the Chairman of the People's Committee of Que Son district on resolving Ms. Nguyen Dinh Le Thuy's complaint is in accordance with the legal provisions as stated above.

The discussion opinions of the sectors agreed with the review and verification report of the Provincial Inspectorate. Chief Inspector of the province Nguyen Duc Tien concluded that he would recommend the Chairman of the Provincial People's Committee to resolve the complaint of Ms. Nguyen Dinh Le Thuy against Decision No. 1096 dated July 31, 2024.

Propose that the Chairman of Que Son District People's Committee continue to implement Decision No. 1349 dated July 17, 2024 on resolving the complaint of Ms. Nguyen Dinh Le Thuy. The Chairman of Que Son District People's Committee learns from the limitations in formulating plans, completing compensation plans, support and resettlement land arrangement when the State reclaims land to ensure the time according to regulations.
