4 more groups of officials enjoy policies when they leave their jobs to reorganize the apparatus

The government has just issued Decree 67, amending Decree 178, which adds several groups of officials and civil servants who are eligible for benefits upon retirement in order to reorganize the political system's apparatus.


Accordingly, Decree 67 expands the scope of regulation, amendment, and supplementation to clarify the agencies, organizations, and units within the scope of regulation for 6 groups of agencies and units and 4 groups of beneficiaries of the policy.

Decree 67 also adds regulations on funding sources for implementing the regime for civil servants and employees in public non-business units (Illustrative image).

The decree stipulates policies and regulations including: policies and regulations for those leaving their jobs (early retirement and resignation); policies for those elected, appointed to lower leadership and management positions, or who cease to hold leadership and management positions; policies to encourage officials and public employees to increase their work assignments at the grassroots level; policies to prioritize individuals with outstanding qualities and abilities; policies for training and improving the skills of officials and public employees after restructuring...

The six groups of agencies falling within this scope include agencies of the Communist Party of Vietnam , the State, the Vietnam Fatherland Front, political and social organizations at the central, provincial, and district levels, and the armed forces.

Administrative organizations at all levels, from the central to the district level, directly implement organizational restructuring or, while not directly involved in organizational restructuring, carry out downsizing, restructuring, and improvement of the quality of cadres and civil servants.

Group three consists of public service units that directly implement organizational restructuring or, while not directly involved in organizational restructuring, carry out downsizing, restructuring, and improvement of staff quality.

These are units within the organizational structure of agencies and organizations from the central to the district level, and administrative organizations of agencies and organizations from the central to the district level.

Units under provincial and city Party committees directly under the Central Committee, and district, town, and city Party committees under provinces and centrally-administered cities; units under provincial and district People's Committees; and units under political and social organizations at the provincial level.

Group four consists of other public service units not belonging to group three mentioned above that have completed organizational restructuring within 12 months from the date of the restructuring decision by the competent authority.

Next are the groups of agencies, organizations, and units resulting from the reorganization of administrative units at all levels.

Finally, there are the associations assigned by the Party and State at the central, provincial, and district levels to carry out the reorganization, consolidation, and merger of organizational structures.

Decree 67 also amends and supplements Article 2 regarding the scope of application for implementing the conclusions of the Politburo .

The first group includes officials, civil servants, employees working under labor contracts in agencies, organizations, and units specified in Article 1 of this Decree, and the armed forces who are directly affected by the implementation of organizational restructuring and administrative unit reorganization at all levels.

Specifically: Public officials and employees who do not hold leadership or management positions; commune-level officials and civil servants; individuals working under labor contracts for certain types of jobs in administrative agencies and public service units as prescribed by law before January 15, 2019; and individuals working under labor contracts who are subject to the same policies as public officials.

Officers, professional soldiers, workers, defense officials, and contract workers receiving salaries from the state budget belonging to the Vietnam People's Army.

Officers, non-commissioned officers receiving salaries, police workers and contract workers receiving salaries from the state budget within the People's Public Security; and those working in cryptographic organizations.

Officials, civil servants, and public employees holding leadership and management positions in the agencies, organizations, and units specified in Clauses 1, 2, 3, and 5 of Article 1 of this Decree, who wish to resign to facilitate the arrangement of the number of officials, civil servants, and public employees holding leadership and management positions in accordance with the law in the implementation of the organizational restructuring of the political system.

The second group consists of officials, civil servants, public employees, and workers receiving salaries from the state budget as prescribed by law before January 15, 2019, and members of the armed forces with five years or less remaining until retirement age in the agencies, organizations, and units specified in Article 1 of this Decree. They are not directly affected by the organizational restructuring but must implement downsizing, restructuring, and improvement of the quality of officials, civil servants, and public employees.

Next are the groups of people working within the staffing quota and receiving salaries from the state budget at associations assigned tasks by the Party and State at the central, provincial, and district levels, who are directly affected by the implementation of organizational restructuring, consolidation, and merger.

Finally, there is the group of officials who are not old enough to be re-elected or re-appointed as stipulated in Clauses 1, 2, and 3 of Article 2 of Government Decree No. 177 of 2024, which regulates the regime and policies for cases of non-re-election or re-appointment.

Cadres who meet the age requirements for re-election or reappointment to the Party committee at the same level, and whose service time from the date of the congress is between 2.5 years (30 months) and 5 years (60 months) until reaching the retirement age stipulated in Clause 4, Article 2 of Decree No. 177 of 2024.

Cadres currently serving on Party committees at all levels must complete their activities and reorganize their organizational structure. Those with five years or less remaining until retirement age, or who wish to retire early, in order to facilitate personnel arrangements for Party committees during Party congresses at all levels leading up to the 14th National Congress of the Party, must obtain the approval of the competent authority.

Decree 67 also adds regulations on funding sources for implementing the regime for civil servants and employees in public non-business units.

Specifically, for public non-profit organizations that are self-sufficient in covering both recurrent and investment expenditures; and for public non-profit organizations that are self-sufficient in covering recurrent expenditures, the funds for addressing policies and regulations come from the unit's operational revenue and other legitimate revenue sources.

In cases where public service units lack sufficient funds to address policies and regulations, they may use funds allocated according to the regulations of the public service unit to address these policies and regulations.

In cases where public service units are self-sufficient in covering their operating expenses and are contracted by the State through service fees, but these service fees do not fully reflect the constituent elements for addressing policies and regulations, the funding for addressing these policies and regulations will be supplemented by the state budget.

In addition, the Decree supplements the regulations for those working within the staffing quota and receiving salaries from the state budget at associations assigned tasks by the Party and State at the central, provincial, and district levels, who are directly affected by the implementation of organizational restructuring, consolidation, and merger, the funding for resolving policies and entitlements will be provided by the state budget.

For administrative organizations that cease implementing special financial mechanisms such as public service units from January 1, 2025, the funding for policy and benefit implementation will be provided by the state budget.

Regarding the determination of the current monthly salary for calculating policies and benefits, Decree 67 adds a "salary retention differential coefficient" to ensure the rights of officials, civil servants, and employees when they leave their jobs.

Specifically, the current monthly salary is the salary of the month immediately preceding the termination of employment, including: the salary level according to rank, grade, position, title, professional title, or the salary as agreed upon in the labor contract; salary allowances (including: leadership position allowance; seniority allowance exceeding the standard; professional seniority allowance; professional incentive allowance; professional responsibility allowance; public service allowance; allowance for Party and socio-political organization work; special allowance for the armed forces) and the retained salary differential coefficient (if any) as prescribed by the law on salaries.
