Is the time spent studying counted towards vocational allowance?

(Chinhphu.vn) - Ms. Nguyen Thi Diem Chi (HCMC) is a doctor, sent to study long-term CK1 (2 years) in a centralized system, however, she still returns to work at her office when her schedule is free (3 sessions/week). Ms. Diem asked, according to Decree No. 56/2011/ND-CP, is she entitled to receive preferential allowances for her profession?

Regarding this issue, the Ministry of Health responded as follows:

Article 3 of Joint Circular No. 02/2012/TTLT-BNV-BYT dated January 19, 2012 on the implementation of Decree No. 56/2011/ND-CP stipulates the time period not eligible for preferential allowances according to the medical profession :

"1. Time spent on business trips, working or studying abroad is entitled to 40% of salary as prescribed in Clause 4, Article 8 of Decree No. 204/2004/ND-CP;

2. Continuous study time in the country of more than 3 months, not directly working in medical profession according to assigned tasks for civil servants and public employees;

3. Continuous unpaid leave of absence of 1 month or more;

4. Time off work to receive social insurance according to the provisions of the law on social insurance;

5. The period of temporary detention, temporary custody, temporary suspension from work or suspension from medical practice is from 1 month or more.

6. Time spent on business trips or working in non-medical fields continuously for 1 month or more".

Thus, the time spent on long-term concentrated training according to the decision of the competent authority, not regularly and continuously doing medical work according to the assigned tasks for civil servants of competent authorities, is not counted for preferential allowances according to the medical profession.
