The Law on Social Insurance (SI) 2024 will officially take effect from July 1, 2025 with many important new points, notably the expansion of benefits for voluntary SI participants. Accordingly, from this point on, in addition to retirement and death benefits, SI participants will receive additional maternity benefits - a step forward that demonstrates humanity, practicality and is suitable for people's needs.
According to Clause 3, Article 4 of the Law on Social Insurance 2024, the voluntary social insurance regime includes: maternity allowance, retirement and death benefits. This is the first time that maternity allowance has been included in the group of benefits for voluntary social insurance participants, contributing to expanding social security coverage and better ensuring the rights of workers in the informal sector.
According to the provisions of Articles 94, 95, 96 and 97 of the Law on Social Insurance 2024, people who have paid voluntary social insurance or have paid both compulsory social insurance and voluntary social insurance for 6 months or more within 12 months before giving birth will be entitled to maternity benefits if they fall into one of the following cases: Female workers giving birth, male workers whose wives give birth.
In case the mother participates in social insurance and dies after giving birth, the father or the person directly raising the child will receive a subsidy.
In case both father and mother participate in social insurance and meet the conditions for maternity allowance as prescribed in Clause 1, Article 94 of the Law on Social Insurance 2024, only the father or mother is entitled to maternity allowance.
In case a participant is both eligible for maternity benefits in voluntary social insurance and eligible for maternity benefits in compulsory social insurance, he/she will only be entitled to maternity benefits in compulsory social insurance.
In case the mother is eligible for maternity benefits in compulsory social insurance and the father is eligible for maternity benefits in voluntary social insurance, the mother is entitled to maternity benefits in compulsory social insurance and the father is entitled to maternity benefits in voluntary social insurance.
In case the father is eligible for maternity benefits in compulsory social insurance and the mother is eligible for maternity benefits in voluntary social insurance, the father is entitled to maternity benefits in compulsory social insurance and the mother is entitled to maternity benefits in voluntary social insurance.
Beneficiaries will receive 2 million VND for each child born and each case of stillbirth or death during labor at 22 weeks or older. In addition, female workers who are ethnic minorities or Kinh women whose husbands are ethnic minorities in poor households when giving birth will also receive other support policies according to Government regulations.
The source of payment for maternity allowance for voluntary social insurance participants will be guaranteed by the state budget. The allowance level will also be flexibly adjusted by the Government according to the socio-economic development situation and the state budget capacity of each period.
The addition of maternity allowance to the voluntary social insurance policy is a testament to the Party and State's continuous efforts to improve the social security system, ensuring fairness among participating groups. This is also a motivation for people, especially workers in the informal sector, to confidently stick with the voluntary social insurance policy for a long time./.
