Nowadays, electric motorbikes have become popular, especially among students. However, many people do not clearly understand the regulations on the maximum speed of this type of vehicle when participating in traffic, as well as the penalty for violations. 1. Maximum speed of electric motorbikes when participating in traffic

According to Decree 171/2013/ND-CP (now replaced by Decree 100/2019/ND-CP), electric motorbikes are vehicles driven by electric motors, with a capacity not exceeding 4kW and a maximum design speed not exceeding 50km/h. However, according to Circular 31/2019/TT-BGTVT of the Ministry of Transport , electric motorbikes, considered as motorbikes, when participating in traffic must comply with the regulation on a maximum speed of no more than 40km/h. This regulation applies to all types of motorbikes, including electric motorbikes, when traveling on roads (except highways).

Limiting the speed of electric motorbikes helps control speeding and ensure traffic safety. However, in reality, many electric motorbike drivers, especially students, are not fully aware of these regulations, leading to violations and endangering themselves and other road users.

2. Penalty for electric motorbikes exceeding the speed limit

Electric motorbikes are popular among school-age children due to their convenience. However, the risk of causing traffic accidents with electric motorbikes is also very high, especially when the drivers are mainly students who do not have full knowledge of traffic laws. The phenomenon of students racing, speeding, and weaving at school gates has become common and needs to be strictly handled.

Pursuant to Decree 100/2019/ND-CP, the penalty for speeding violations for electric motorbikes is applied similarly to that for motorbikes, mopeds and similar vehicles. Specifically:

- Fine from 200,000 VND to 300,000 VND if the driver exceeds the speed limit from 5km/h to under 10km/h.

- Fine from 600,000 VND to 1,000,000 VND if exceeding speed from 10km/h to 20km/h.

- Fine from 4,000,000 VND to 5,000,000 VND if exceeding speed by more than 20km/h.

- For the act of driving in a group of 2 or more people, exceeding the prescribed speed, the fine can be from 6,000,000 VND to 8,000,000 VND, and the driving license will be revoked for 2 to 4 months. If the offense is repeated, the fine can be increased, along with the confiscation of the vehicle and the driving license will be revoked for 3 to 5 months.
