Ho Chi Minh City prepares to operate new wards and communes: Clear decentralization and delegation of authority

Decentralization and delegation of power to the People's Committees of wards and communes is necessary, but it must be clear and go hand in hand with implementation capacity, avoiding concentrating work on one focal point.

The Ho Chi Minh City Department of Construction has just sent the Department of Home Affairs a proposal on decentralization and authorization to the People's Committees of wards and communes after removing the district level in the field of urban, construction and planning. According to the proposal, the People's Committees of wards and communes will be decentralized to appraise economic and technical reports of public investment projects, and the Chairman of the People's Committee at the commune level will be allowed to decide on investment in Group C projects with budget capital within the administrative boundaries. Some authorities on announcing construction material prices; regulating responsibilities for quality, construction and maintenance of construction works; resolving construction work incidents; managing and exploiting canals and cross-river passenger wharves are also assigned to wards and communes.

In the planning field, the People's Committees of wards and communes are authorized to locally adjust the 1/2,000 scale zoning plan to serve public investment projects; locally adjust the 1/500 scale master plan; locally adjust the planning of the existing central area (930 ha area)...

Regarding construction order management, the Department of Construction proposed not to assign it to the People's Committee at the commune level due to lack of human resources to implement it.

Regarding the district-level public investment apparatus, Chairman of the Ho Chi Minh City People's Committee Nguyen Van Duoc said that during the period from July 1 to August 15, the compensation and site clearance board will be organized in the direction of maintaining the current apparatus, transferred to the Department of Agriculture and Environment for management. After August 15, the Ho Chi Minh City People's Committee will form a land fund development center to carry out the task of site clearance and create land funds to call for investment. At that time, the compensation boards will be upgraded to branches of the land fund development center under the Ho Chi Minh City People's Committee.

Meanwhile, the management board of construction investment projects in districts will be under the Department of Construction, continuing to implement projects within the old district boundaries. This model helps stabilize the apparatus for implementing public investment work. As for public service units such as cultural and sports centers, children's houses, and street management, Mr. Duoc believes that transferring them under the new ward People's Committee will be more effective than transferring them to the departments.

Regarding the operation of the administrative apparatus, Secretary of the Ho Chi Minh City Party Committee Nguyen Van Nen assessed that when the district level ends its operation, the new wards and communes will have a larger scale, more tasks to do and great responsibilities. To prepare well for the operation of the new apparatus, Mr. Nen noted the need to decentralize, delegate power, and clearly define functions and tasks between general authority and specific authority, including the authority of the People's Committee at the commune level.

"If there are no clear instructions and regulations, the people below will not be able to do this," Mr. Nen said, emphasizing that decentralization and delegation of authority must be synchronous, interconnected, without omissions, without overlap, and without interruption in serving people and businesses.

Wards and communes with high population density will increase staffing.

According to the direction of the Steering Committee for the arrangement of administrative units at all levels and the construction of a 2-level local government organization model of the Government , the staffing framework for each commune-level administrative unit is about 32 people. If the commune has more than 16,000 people, the ward, commune in mountainous and highland areas will arrange 1 more staff/1,000 people; the ward, commune, and special zone in other areas will add 1 more staff/2,000 people. However, the maximum number of staff in a commune is not more than 50 people, and in a ward is 70 people.

Compared to Ho Chi Minh City, to arrange a maximum of 50 staff, the commune must have a population of over 52,000, and a ward with a maximum of 70 staff must have a population of over 92,000. According to the population statistics of the Ho Chi Minh City People's Committee when developing a plan to merge administrative units, the whole city has 16 communes with a population of over 52,000 and 42 wards with a population of over 92,000. In addition, Ho Chi Minh City also has 86 wards and communes with a population of over 60,000, which are eligible to establish an additional specialized department if the proposal of the Ministry of Home Affairs is approved. At that time, the People's Committees of wards and communes with a population of over 60,000 will have 4 specialized departments and a public administrative service center.
