The total number of apartments currently being sold and rented through the Airbnb application in Ho Chi Minh City is about 8,740 apartments.
Accordingly, most of the apartments for rent through the Airbnb application in Ho Chi Minh City are for short-term stays, which has led to conflicts between the management board, residents living in the buildings and apartment complexes, and tenants.
Notable are Vinhomes Central Park apartment complex with 4,000 apartments for rent, River Gate with 650 apartments for rent, Thao Dien Masteri, Lumiere with 400 apartments for rent, Saigon Royal with 250 apartments for rent, Millennium with 350 apartments for rent.
To remove obstacles for the model of renting apartments through the Airbnb application, the Ho Chi Minh City Real Estate Association has just sent a document to the Ho Chi Minh City People's Committee and the Ho Chi Minh City Department of Construction, requesting consideration of amending and supplementing Article 12 of Decision 26 dated February 27, 2025, regulating the management and use of apartment buildings in the city.
Accordingly, the association recommends that the exploitation of apartments used as accommodation facilities in apartment buildings must comply with the provisions of the law on construction.
Organizations and individuals doing business in accommodation services must meet the conditions and standards prescribed by the law on housing, the law on real estate business, and the law on tourism .
Must comply with the provisions of law on conditional business investment industries and professions, must register business and pay taxes according to the provisions of law.
In addition, organizations and individuals providing accommodation services in apartment buildings and tenants staying in apartment buildings must register temporary residence and notify the residence of apartment tenants who are Vietnamese citizens, foreigners, and Vietnamese people residing abroad according to current laws.
Temporary residence registration and residence notification are carried out directly at the police station at the commune, ward or town level.
Lessors and apartment lessees must fully comply with the regulations on management and use of apartment buildings and other relevant legal regulations.
In addition, the Ho Chi Minh City Real Estate Association also proposed that the National Assembly Standing Committee consider adding an explanation of the terms for the concepts of "using an apartment for residential purposes" or "using an apartment for non-residential purposes" so that localities can unify their understanding and facilitate the implementation of the 2023 Housing Law.
