The Ho Chi Minh City Department of Transport has just issued a document guiding the implementation of a number of regulations on the management and temporary use of a part of the roadway and sidewalk in the city. It is expected that the city will apply new regulations on the management of roadway and sidewalk from January 1, 2024.

According to the guidance of the Ho Chi Minh City Department of Transport, the roadway and sidewalks are only used for traffic purposes. In case of use other than this purpose, the Department of Transport, the People's Committee of the district, and Thu Duc City will consider and grant a temporary license to use a part of the roadway and sidewalk, but must ensure the criteria and comply with Decision 32/2023 of the Ho Chi Minh City People's Committee.

Specifically, the temporary use of sidewalks for business services, buying and selling goods, the sidewalk must be at least 3m wide. When organizing this activity, the remaining sidewalk for pedestrians must be at least 1.5m wide (not including the scope of tree roots, green space and the area for arranging technical infrastructure on the occupied sidewalk), continuous and without obstacles.

In particular, this must be limited to a number of locations that affect the operations of agencies, offices, diplomatic headquarters, religious and medical facilities, and schools.

Specifically, the Department of Transport of the City organizes the collection of fees for temporary use of the roadway, including median strips and traffic islands on the roads managed by the department. The People's Committees of localities organize the collection of fees for temporary use of the roadway and sidewalks on the roads managed by the locality.

The fee for parking is from 20,000 - 350,000 VND/m2/month; the fee for other activities is from 20,000 - 100,000 VND. The proposed fee depends on the average land price in 5 areas.

Specifically, area 1 includes: districts 1, 3, 4, 5, 10, Phu Nhuan, Area A of the South City New Urban Area, Thu Thiem New Urban Area with 207 routes.

Area 2 includes: District 2 - now part of Thu Duc city (except Thu Thiem new urban area), District 6, 7 (except Area A of the new urban area in the South of the city), District 11, Binh Thanh, Tan Binh, Binh Tan), with 277 routes.

Area 3 includes: District 8, old District 9, District 12, old Thu Duc District, Tan Phu District, Go Vap District with 248 routes.

Area 4 includes: Binh Chanh, Hoc Mon, Nha Be, Cu Chi districts with 125 routes.

Area 5 has 11 roads in Can Gio district.

In which, area 1 includes districts 1, 3, 4, 5, 10, Phu Nhuan, area A of the new urban area of ​​the South of the city, and Thu Thiem new urban area, will have the highest fee. On the contrary, area 5 is Can Gio district will have the lowest fee.

According to the instructions of the HCM City Department of Transport, there will be a total of 9 cases that must pay usage fees, including 6 cases of sidewalk use and 3 cases of road use.

6 cases that must pay sidewalk usage fees include locations for organizing business services, buying and selling goods; locations for arranging works and utilities serving public transport, installing temporary works, works serving traffic organization on sidewalks, median strips, traffic islands; organizing cultural activities, propagating the Party's policies and the State's laws; parking and parking points serving cultural activities; transfer points for materials and construction waste to serve construction works; parking and parking points with collection of parking service fees.

3 cases of temporary use of part of the roadway with a fee, including: Organizing cultural events and keeping cars for the event; domestic waste transfer point of urban environmental sanitation enterprises; car parking point with service fee collection.
