The Decree stipulates that citizens who come to the identification management agency specified in Clause 1 and Clause 2, Article 27 of the Law on Identification to request the issuance, exchange, or re-issuance of an identification card must provide information including their last name, middle name, birth name, personal identification number, and place of residence so that the recipient can check and compare the information in the National Population Database.
In case the person requesting the issuance, exchange or re-issuance of an ID card is the legal representative of a person under 14 years of age, the application for the issuance, exchange or re-issuance of an ID card must have legal documents and papers proving that he/she is the legal representative of the person under 14 years of age.
The Decree clearly states that in case a citizen's information in the National Population Database is not available or is incorrect, the recipient shall adjust the information according to the provisions of Article 6 of Decree 70/2024/ND-CP before requesting the issuance, exchange, or re-issuance of an ID card.
In case the citizen's information is correct, the person receiving the request for issuance, exchange or re-issuance of an ID card shall extract information about the citizen from the national population database. After determining that the information of the person requesting the issuance, exchange or re-issuance of an ID card is correct, the person shall carry out the procedures for issuing an ID card according to the provisions of Article 23 of the Law on Identification.
The Decree stipulates that citizens select procedures and check their information exploited in the National Population Database. If the information is correct, they will register the time and the identity management agency to carry out the procedure. The system will confirm and automatically transfer the citizen's request to the identity management agency where the citizen requests to issue, change, or reissue an identity card.
Citizens come to the identification management agency at the registered time and location to carry out procedures for issuing, exchanging, and reissuing identification cards according to the order and procedures for issuing, exchanging, and reissuing identification cards at the identification management agency.
In case of lost ID card or damaged ID card that cannot be used, choose the re-issuance procedure, check your information exploited in the National Population Database. If the information is correct, confirm the transfer of the application for re-issuance of ID card to the ID management agency for consideration and settlement of the re-issuance of ID card according to the provisions of Clause 4, Article 25 of the Law on ID.
In case the legal representative carries out the procedures for issuing, exchanging, or reissuing an ID card for a person under 6 years old, he/she shall select the procedure and check the information of the person under 6 years old in the National Population Database. If the information is correct, the legal representative shall confirm and transfer the application to the ID management agency for consideration and settlement of the issuance, exchange, or reissuance of the ID card.
The Decree clearly states that in the case of issuing a change from a citizen identification card to an identification card or issuing a change from an identification card, the recipient is responsible for collecting the identity card, citizen identification card, or identification card in use.
In case a citizen does not come to the place to carry out procedures for issuing, exchanging, or reissuing an ID card according to the time and place registered for an appointment with the ID management agency to carry out procedures for issuing, exchanging, or reissuing an ID card, the system receiving the citizen's request will automatically cancel the citizen's registered appointment at the end of the working day.
If citizens continue to need to issue, change, or reissue ID cards, they must register for an appointment again.
The above regulations take effect from July 1, 2024.
