Minister Tran Hong Minh said that after 10 years of implementation, the 2014 Construction Law has revealed many shortcomings and needs to be amended to improve the law, create an open and transparent investment environment, reduce compliance costs and simplify administrative procedures in construction investment activities. The draft Law consists of 8 chapters and 97 articles, 71 articles less than the current law, focusing on 3 major groups of contents:
- Innovation in construction investment management methods.
- Reduce procedures and business conditions.
- Clearly define management responsibilities between the State and entities participating in construction.
Chairman of the Committee for Science , Technology and Environment Nguyen Thanh Hai emphasized that the draft needs to ensure the spirit of "strongly shifting from pre-control to post-control, associated with increased supervision", clearly distinguishing between public investment projects and projects with private capital. The Committee also proposed reviewing regulations on exemption from construction permits, ensuring safety, avoiding the emergence of "sub-licenses"; at the same time, adding strong sanctions for projects that violate design, have incorrect functions or change construction density.
The new law aims to improve the investment environment, enhance management efficiency, while ensuring quality, construction safety and the legitimate rights of people and businesses.
