The meeting reviewed and gave opinions on 7 contents, including 6 contents on draft laws and proposals for law making, including: Draft Law on Temporary Detention, Temporary Imprisonment and Prohibition from Leaving Place of Residence; Draft Law on Criminal Judgment Execution (amended); Law on Thrift and Anti-Waste; Law on Food Safety (amended); Law on Population; Law on Judicial Expertise (amended).
Along with that, the Government listened to reports and gave opinions on handling problems arising in the construction of decrees related to decentralization, delegation of power, and division of authority associated with the organization of two-level local governments.
Speaking at the meeting, Prime Minister Pham Minh Chinh said that recently, the Politburo issued Resolution 66 on innovating the work of law making and enforcement to meet the requirements of national development in the new era. The National Assembly passed Resolution 197, and the Government issued Resolution 140 to promptly implement and bring Resolution 66 into life and promote its effectiveness.
The Prime Minister assessed that with institutional thinking, law is both a resource and a driving force for development. The work of building institutions and laws has been innovated in the direction of changing the mindset from focusing on management, if you can't manage, then ban, to creating and serving people and businesses.
The Prime Minister requested that the law amendment be carried out in the spirit of "6 clears", clearly answering why: inherited and omitted contents; amended and improved contents; supplemented contents; contents of reduction and simplification of administrative procedures; contents of decentralization and delegation of power, specifically what, for whom; issues with different opinions and other issues that need to be reported to the Government Standing Committee, the Government, and the Prime Minister for consideration and direction.
Along with that, the construction of new laws must also be based on the spirit of "7 clear": how are the Party's guidelines and policies concretized; what are the practical issues that the law has not yet regulated; what are the issues that the law has regulated but is not suitable; what are the problems that need to be resolved; how to simplify and reduce administrative procedures; how to decentralize and delegate power; issues with different opinions that need to be reported to the Government and the Prime Minister.
The Prime Minister emphasized the spirit of "what is ripe, clear, proven to be correct by reality, and agreed and supported by the majority" should be legalized and applied in practice; issues that are still fluctuating and complicated must continue to be researched, perfected, and gradually expanded, without being perfectionist or hasty; respecting reality, sticking closely to reality, starting from reality, taking reality as a measure, and removing difficulties, obstacles, and shortcomings in reality.
