Previously, in 2020, the Provincial People's Committee concluded (signed by Mr. Mai Hung Dung, Permanent Vice Chairman of Binh Duong Provincial People's Committee): The construction of some construction items on the ground floor and first floor was contrary to the licensed design drawings, used for the wrong purpose, such as: building office walls, partitions with plasterboard and glass for other units to rent as headquarters, building showrooms for Charm City project model houses...
In particular, the investor blatantly sold part of the ground floor and first floor area to two different individuals: Ms. Tran Thi Thanh Van (Contract for purchasing the store, signed on January 19, 2019 for over VND 29 billion) and Ms. Tran Thi Kim Ngoc (Contract signed on January 15, 2019, for nearly VND 15 billion), while there was no unified document determining the common/private ownership area between the investor and the apartment buyers. This is an act strictly prohibited by law.

From there, the Provincial People's Committee directed the Department of Construction, the Department of Natural Resources and Environment and relevant agencies to coordinate to inspect and clarify a number of issues arising at the Charm Plaza apartment building (Block B1), including the operating conditions of the VNVC Vaccination Center on the first floor, ensuring technical design space, fire prevention and fighting safety in the basement parking lot, and the legality of buying and selling floor areas on the ground floor and first floor.
At the same time, assign the People's Committee of Di An City and the People's Committee of Di An Ward to promptly monitor and supervise the process of the investor implementing remedial measures at the apartment building (Block B1).

Previously, DCT Vietnam Co., Ltd. - the investor had a document requesting approval to change the function of Charm Plaza apartment building (Block B1) with confirmation from the Management Board regarding the change of function of the ground floor and first floor, but was refused to be resolved by the Director of the Department of Construction, after reviewing the documents that were not in accordance with the drawings and regulations of the law.
Thus, the fact that investors brazenly took public areas to sell, rent and use as model houses for profit has been going on for many years. However, until now, everything has not been thoroughly resolved, despite the direct direction of the Secretary himself as well as the Provincial People's Committee.
At the same time, many residents have been constantly fighting to reclaim this area to serve the community, but they are extremely upset about the situation of "the superiors not listening to the subordinates". In particular, the investor shows signs of procrastination, disregarding the provisions of the law, the direction of the leaders of the Provincial Party Committee, the People's Committee of Binh Duong province and the functional departments.
In fact, currently, the VNVC Vaccination Center (in operation since June 16, 2020), offices: Cam Phung Transaction Office, Kim Van Furniture, Exhibition Room for sale of 2 Rubu and Saphia buildings (newly moved)... up to thousands of square meters are still operating normally. The public areas for residents are now blatantly "cut up" by the investor to sell/lease/use. So who benefits from this when it is obvious that they are not residents of Charm Plaza, as they have reflected?
There are many uncertainties
Currently, many residents have also filed complaints to the authorities and Nguoi Dua Tin about the sale and liquidation of all the building's elevator cables without notifying residents to put into the apartment fund. Or since 2022, the building's management board, represented by Mr. Than Van Hau, signed a contract with Vietnam Apartment Management Services Joint Stock Company to entrust the operation of the building under the collection-payment method, but did not make it public to residents, did not go through a public bid, and did not receive authorization from residents. So, is Vietnam Apartment Management Services Joint Stock Company still operating the building in accordance with the law?
Residents said that the building management board had interfered with the apartment's electrical system, disconnecting the apartment's electrical system from the generator...
In addition, there is also content about signing a fire insurance contract with a total amount of nearly 200 million VND (total insured value is 350 billion VND) but the beneficiary is the Management Board of Charm Plaza apartment building. In particular, the Management Board of the building intervened in the electrical system of the family apartment, disconnecting the electrical system of the apartment from the generator...
Regarding the above contents, working with reporters, Mr. Vo Tuong Van, Chairman of Di An Ward People's Committee said: "Regarding Charm Plaza apartment building, there are many incidents that have occurred for a long time and the Ward People's Committee has also received many petitions from residents related to different contents.
In July 2023, the Ward People's Committee worked with relevant parties and agreed on a number of contents regarding the electrical system in the building. Currently, there is a written response from the fire prevention and fighting agency (PC07, Binh Duong Provincial Police). Therefore, we request the Management Board and residents to coordinate with the investor to implement. Regarding the change of the function of the apartment building, we request the investor to organize the implementation according to the conclusion of Binh Duong province.
