The Ministry of Agriculture and Environment has drafted a law amending and supplementing a number of articles of the 2024 Land Law, and is seeking opinions from a number of units before finalizing the draft to submit to the National Assembly at the 10th session.

Notably, the draft law has amended and supplemented Article 257 in the direction of removing the provision on additional land fee collection.

Specifically, Point d, Clause 2, Article 257 stipulates as follows: The Government shall prescribe the application of land valuation methods and the amount of money that land users must pay additionally for the period of time not yet calculated for land use fees and land rent in the cases specified in Points a, b and c of this Clause.

Meanwhile, the draft law has been adjusted in the direction of "The Government shall prescribe the application of land valuation methods for the cases specified in points a, b and c of this clause".

That is, the regulation on collecting additional land fees for the period of time not yet calculated for land use fees and land rent has been eliminated.

Speaking to Tuoi Tre Online on the morning of July 29, leaders of many real estate businesses said that removing the regulation requiring additional land payment is reasonable because the delay in calculating land use fees is not the fault of the business. Therefore, when this regulation is removed, businesses will reduce their financial burden, directly impacting the cost structure, contributing to reducing housing prices.

Even many businesses avoid the risk of bankruptcy because for many businesses, the additional amount of 5.4% each year amounts to hundreds of billions, thousands of billions of VND.

Meanwhile, experts said that the law drafting agencies have listened to professional comments from public opinion to continue adjusting the law when practical implementation of the law has created problems that directly affect people and businesses.

Previously, the Ministry of Finance proposed a plan to reduce the additional land use fee from 5.4% to 3.6% per year in the draft amendment to Decree 103.

According to the Ministry of Finance, the regulation on land users having to pay additional fees in the case of transitional handling is stipulated in the Land Law, so Decree No. 103 only provides specific guidance on the collection level of this fee. Therefore, in response to the suggestions not to collect, the Ministry of Finance has sent an official dispatch to the Ministry of Agriculture and Environment (the agency in charge of drafting the Land Law) requesting to preside over handling the recommendations according to its authority or submit them to the competent authority for consideration and handling.
