Additional sanctions to handle businesses that do not adhere to the roadmap for reducing emissions

On the morning of November 7, Deputy Prime Minister Tran Hong Ha chaired a meeting with the Ministry of Transport and relevant ministries and branches on the Prime Minister's draft decision stipulating the roadmap for applying emission standards to imported, manufactured and assembled motor vehicles.


Proposal that from 2026, 4-wheel vehicles must have zero emissions

According to the report of the drafting agency (Ministry of Transport), the application of motor vehicle emission standards in recent times has contributed to limiting the increase in air pollutant emissions, improving the environment in urban areas; and preventing and limiting old, outdated technologies and vehicles that cause environmental pollution from entering Vietnam.

Draft decision on motor vehicle emission standards transitioning to emission standards currently implemented under Decision No. 249/2005/QD-TTg, Decision No. 29/2011/QD-TTg, and part of Decision No. 16/2019/QD-TTg.

Specifically, from January 1, 2025, newly imported cars and manufactured and assembled cars will continue to apply level 5 emission standards; newly imported motorbikes and manufactured and assembled motorbikes will continue to apply level 2 emission standards; newly imported motorbikes and manufactured and assembled motorbikes will continue to apply level 4 emission standards; and used imported cars will continue to apply level 4 emission standards.

The draft decision narrows the scope of regulation to motor vehicles with imported, manufactured, and assembled heat engines; raises the emission standards for imported, manufactured, and assembled two-wheeled motorbikes from level 3 to level 4 from January 1, 2027.

From January 1, 2026, the emission standard of "0" will be applied to imported, manufactured and assembled 4-wheeled passenger vehicles, 4-wheeled cargo vehicles with engines; imported and assembled 3-wheeled motorbikes and 3-wheeled motorbikes.

Motor vehicles not subject to emission standards include: Motor vehicles of the Ministry of National Defense and the Ministry of Public Security used for national defense and security purposes; motor vehicles used for scientific research, research serving production, display, and introduction at fairs and trade exhibitions; motor vehicles manufactured and assembled for export; motor vehicles imported under the provisions of international treaties; motor vehicles designed with special structures not for the purpose of participating in road traffic; motorcycles and three-wheeled motorbikes for the disabled; automobiles manufactured and assembled from basic automobiles that have been certified for technical safety and environmental protection.

The draft also stipulates specific responsibilities of the Ministry of Transport, Ministry of Science and Technology, Ministry of Industry and Trade, ministries, People's Committees of provinces and centrally run cities in organizing the implementation of the roadmap for applying emission standards prescribed in the Decision.

Supplementing regulations on inspection, supervision and handling of enterprises that do not comply with the roadmap

After listening to the opinions of representatives of the Ministry of Transport, the Ministry of Natural Resources and Environment, and the Ministry of Industry and Trade, the Deputy Prime Minister requested the drafting agency to review and ensure the roadmap for applying appropriate emission standards, consistent with the Road Law, the Law on Environmental Protection, and with Decision No. 876/QD-TTg of the Prime Minister approving the Action Program on green energy conversion, reducing carbon and metal emissions of the transport sector.

The implementation of the roadmap must be feasible, closely follow the Party and State's guidelines and policies, be suitable to socio-economic conditions and international commitments and agreements on the environment that Vietnam participates in; and not overlap in terms of subjects and scope of regulation.

In implementation, the Ministry of Transport is responsible for inspection, examination, synthesis and reporting. The Ministry of Industry and Trade is responsible for motor vehicle import activities (together with the General Department of Customs), production and assembly of motor vehicles at domestic enterprises.

The Ministry of Planning and Investment is responsible for foreign direct investment projects, establishment of enterprises for importing, manufacturing and assembling motor vehicles. The Ministry of Natural Resources and Environment is responsible for promulgating general regulations and standards for environmental protection regulations in general.

People's Committees of provinces and centrally run cities, based on socio-economic conditions, traffic infrastructure and environment in the area, shall promulgate and implement a roadmap to apply emission standards earlier, more strictly and closely.

"The decision must supplement regulations on inspection, supervision and sanctions for businesses that do not follow the roadmap," said the Deputy Prime Minister.

The Deputy Prime Minister also assigned the Ministry of Transport to study and propose a plan to apply Level 4 emission standards to newly imported motorbikes and manufactured and assembled motorbikes as soon as possible.
