Need for security mechanism to avoid retaliation and persecution of informants about waste

This content was presented at the conference of specialized National Assembly deputies on the morning of September 30, when National Assembly deputies gave comments on the draft Law on Thrift and Anti-Waste.

In the context that the whole country is carrying out administrative reform, digital transformation and anti-corruption and negativity prevention, the female delegate affirmed that it is extremely necessary for the National Assembly to consider this draft law.

The law not only aims to save resources and combat waste, but also contributes to improving discipline, order, accountability, and increasing transparency in State management activities and in the whole society, according to Ms. Huong.

The draft law clearly defines mandatory disclosure contents, requires disclosure of wasteful behavior and handling results, along with information about violating agencies, organizations, and individuals.

Ms. Huong said that this is a new regulation that contributes to strengthening deterrence, accountability and is also a tool for people to monitor. However, the female delegate suggested that it is necessary to clearly stipulate the time for public disclosure. For example, after how long after detecting and handling wasteful behavior, it must be made public.

“Without a specific time limit, the disclosure may be delayed and reduce the effectiveness of supervision,” Ms. Huong stated.

In addition, the female delegate proposed adding appropriate forms of disclosure for each type of information and having sanctions in cases of non-disclosure, incomplete disclosure or formal disclosure.

In particular, Ms. Huong said that it is necessary to clearly define the personal responsibility of the head if the agency does not publicly disclose or only publicly discloses in a formal manner.

Delegate Nguyen Minh Tam (Quang Tri) was concerned about the regulations on providing and processing information on waste detection and protecting those fighting against waste. According to her, these are very important contents but the design in the draft law is not suitable.

Ms. Tam suggested studying regulations to clarify the rights and responsibilities of agencies, organizations and individuals in providing information on waste detection because this content is still general and unclear.

Along with protecting anti-waste fighters and their relatives, agencies and organizations providing information, the female delegate suggested that it is necessary to clearly regulate information confidentiality to avoid cases where they can be retaliated against or persecuted.

In addition, according to Ms. Tam, it is necessary to clearly stipulate the right to know about the handling of information provided by authorities to encourage citizens to participate in the fight against waste.

Regulations on norms and standards as a basis for determining savings and waste, according to delegate Tam, are also very important because to practice savings, we must first block the source and cause of waste, the most important of which is to manage the source of money that gives rise to wasteful spending, which are norms, standards, and regimes.

Therefore, the establishment of norms, standards and regimes must ensure scientificity, be consistent with the requirements, tasks and objectives set out and must be closely assessed and monitored to avoid waste from the source.

“Practice has shown that setting a higher standard than required will lead to organizations and individuals seeking to disburse all capital, causing loss and waste. On the other hand, there are cases where the target has been achieved but the capital has not been fully used and returned. If it is considered economical, it is not correct and not appropriate,” Ms. Tam stated her opinion.

Delegate Mai Van Hai (Thanh Hoa) also said that the regulation on handling information on waste detection is important but the regulation in the draft law is still general. For example, the head of the agency receiving the information is responsible for reviewing and handling it, but they only review information related to their agency or unit.

“Information about waste detection must be classified very specifically. If it is directly related to an organization, the head of that organization is responsible for reviewing and concluding whether or not there is waste. In cases where information related to waste is not the responsibility of that organization, they must be responsible for transferring it to the competent authorities for review and resolution,” Mr. Hai suggested.
