Expanding intellectual property protection in healthcare

Delegate Pham Nhu Hiep (National Assembly Delegation of Hue City), Director of Hue Central Hospital, emphasized that the medical field has a very wide scope, directly affecting physical and mental health and social life, including many contents related to intellectual property.

“Currently, Vietnam has not yet formed a pharmaceutical market strong enough to develop a drug copyright system. Meanwhile, medical records, professional data, and technical processes in medical examination and treatment are all valuable intellectual products, but have not been fully considered for protection,” analyzed delegate Hiep Pham Nhu Hiep.

According to Mr. Hiep, in many countries, the use of advanced medical procedures or techniques requires paying copyright fees, thereby encouraging creativity and honoring the value of intellectual property in medicine. “I propose adding content on intellectual property in the medical field to this draft law, thereby gradually affirming the position of Vietnamese medicine. Many of our treatment methods and techniques are completely worthy of being protected as intellectual property,” he said.

Delegate Pham Nhu Hiep also mentioned forensic psychiatric assessment - a special field that requires high professional competence and is subject to many occupational risks. "Not all doctors are qualified to perform forensic psychiatric assessment, especially in complex cases with traumatic or pathological factors. Therefore, it is necessary to have more specific regulations on the mechanism to protect assessors, both to ensure objectivity and to avoid legal risks for them when performing their duties," Delegate Pham Nhu Hiep suggested.

Participating in giving comments on the draft Law amending and supplementing a number of articles of the Law on Intellectual Property, Deputy Head of the Delegation of National Assembly Deputies of Hue City Nguyen Thi Suu highly appreciated the draft's updating, especially its approach to international trends. However, Ms. Suu said that there are still points that need to be carefully adjusted to avoid overlap and increase feasibility.

Delegate Nguyen Thi Suu gave an example: Expanding the concept of industrial design to “non-physical products” such as graphic interfaces, icons or animations is suitable for the digital age, but specific criteria are needed for assessment and protection. “The Government should specify in detail the criteria and conditions for protection of non-physical industrial designs to ensure uniformity in implementation,” Ms. Suu proposed.

Regarding data mining for artificial intelligence (AI) training, delegate Nguyen Thi Suu said that current regulations do not clearly define the scope of non-commercial use and the obligation to make data transparent. “When data is used for commercial purposes or has sensitive elements, permission must be sought from the rights holder to ensure a balance between protecting copyright and promoting innovation,” Ms. Suu said.

Turning to comments on the Law on Anti-Corruption (amended), delegate Nguyen Thi Suu said that the development of a set of criteria for assessing anti-corruption work is necessary, but should not be completely assigned to the Government. "If the Government is completely responsible for detailed regulations, it will reduce transparency and limit the National Assembly's supervisory role," she analyzed, and at the same time proposed to retain some hard criteria in the law such as: Rate of recovery of corrupt assets, level of publicity, transparency and people's satisfaction.

Regarding asset and income control, delegate Suu said that the dispersion of authority among many agencies can easily lead to overlap and lack of data consistency. Ms. Suu proposed assigning the Government Inspectorate to be the focal point for unified management, connection and sharing of national data on assets and income of those who are required to declare.

Proposal to collect fees only from the judgment debtor

In the same discussion group with the Hue City National Assembly Delegation, delegate Nguyen Cong Long (Dong Nai Delegation) focused on giving comments on the draft Law on Civil Judgment Enforcement (amended), in which he proposed clarifying the two-level organizational model: Including the provincial Civil Judgment Enforcement Department and the affiliated regional departments to ensure unity and efficiency.

Mr. Long said that this organization helps streamline the apparatus, but it is necessary to clearly define the authority and responsibility between the regional enforcement agency and the People's Procuracy at the same level. The delegate also proposed to only collect fees from the person who must enforce the judgment, because "this is the party that does not voluntarily comply with the judgment, forcing the State to enforce it."

Meanwhile, delegate Pham Trong Nghia (Lang Son Delegation) proposed to maintain the mechanism of appointing judicial appraisers based on professional field instead of workplace, and at the same time expand the scope of allowing highly qualified foreigners to participate in appraisals on a case-by-case basis, especially in fields with international elements.

Mr. Nghia also agreed to expand the scope of activities of private forensic examination offices, and proposed adding the fields of cosmetics and food safety, to meet social needs and reduce the burden on the public examination system.
