Need a mechanism to remove difficulties in exploiting mineral mines for transportation

In the Draft Resolution of the National Assembly on piloting a number of specific mechanisms and policies on investment in the construction of road traffic works, regarding policy 4 on specific mechanisms in the exploitation of mineral mines for common construction materials (Article 7): Investors and construction contractors do not have to carry out procedures for granting a License to exploit mineral mines for common construction materials included in the Construction Materials Survey Dossier for road traffic infrastructure projects.

Investors and construction contractors are responsible for conducting environmental impact assessments; being subject to management and supervision of mineral exploitation and use; paying taxes and fees and performing obligations to protect, improve and restore the environment in accordance with relevant laws on taxes, fees and environmental protection laws.

According to the Government , the proposed policy aims to shorten the time for granting licenses for mining minerals for common construction materials, promptly meet the supply of materials, ensure construction progress, avoid speculation and price increases; at the same time, contribute to stabilizing prices of common construction materials, limiting the increase in construction costs.

The Government proposes to implement a policy similar to Clause 2, Article 5 of Resolution No. 43 of the National Assembly on fiscal and monetary policies to support the Socio -Economic Recovery and Development Program, applicable to 16 projects in the provinces of Thai Binh, Nam Dinh, Lai Chau, Lao Cai, Ninh Binh, Dong Nai, Lam Dong, Tien Giang, Dong Thap, Can Tho, Bac Kan, Kien Giang, Bac Lieu, Tra Vinh, Soc Trang, Cao Bang, Lang Son, Hau Giang.

Discussing in groups on the afternoon of October 27, the majority of National Assembly deputies agreed with the necessity of issuing a Resolution on a number of specific mechanisms and policies on investment in the construction of road traffic works.

National Assembly Deputy Nguyen Quoc Luan expressed his opinion at the group discussion session.

Commenting on the specific mechanism for mining minerals for common construction materials stipulated in Article 7, delegate Nguyen Quoc Luan (Yen Bai delegation) said that Clause 1 of the draft stipulates: Investors and construction contractors do not have to carry out procedures for granting a License for mining minerals for common construction materials included in the construction material survey dossier for road traffic infrastructure projects.

“We understand that such regulations are to remove difficulties for projects to speed up progress, however, to put a mineral mine into operation, it is not as simple as just having a license,” said Mr. Luan.

Mr. Luan emphasized that, especially in the field of mineral exploitation, many projects are implemented in mountainous areas, so many procedures are required such as converting forest purposes, land procedures, etc. If only the mineral exploitation license is removed, it will still be entangled as usual.

“If a special mechanism is given for mineral mining, it is necessary to implement everything from licensing to forest conversion, land procedures, etc.,” Mr. Luan said, citing examples of power line projects that were stuck for a whole year with only a few power poles in natural forests.

Speaking at the meeting, delegate Do Duc Duy - Head of the Yen Bai National Assembly Delegation said that exempting licenses is just one thing, because mineral exploitation projects in general, including mineral exploitation for construction materials, have two important documents: Mineral exploitation license and investment project approved by competent authorities.

Mr. Duy said that currently, there is only a regulation on exemption from licenses, but it has not yet been regulated on whether or not an investment project must be established, because procedures for environmental impact assessment, land lease, land use conversion, etc. must all be implemented based on investment projects that have been approved by competent authorities," Mr. Duy said, and believes that project investment procedures should be exempted.

"If investment procedures are exempted, environmental procedures, land lease, and forest use conversion will only be done based on construction material survey reports, which is very simple. Otherwise, the exemption of licenses will not solve the current practical difficulties," said Mr. Duy.

Delegate Dang Hong Sy (Binh Thuan delegation) also said that the mineral exploitation license is only the first step, to be able to exploit, many other related documents are required.

“In particular, environmental impact assessment is also very elaborate. In the past, there was a situation where even though the mining license was obtained, mining was still not possible because other procedures had to be completed. This directly affected the progress of transportation projects,” Mr. Sy said, adding that, in particular, there needs to be clear guidance to speed up the progress of mining materials for transportation projects .
