Consider regulations on the validity of ordinary passports issued under simplified procedures

Briefly presenting the Draft Law on amending and supplementing a number of articles of 10 laws related to security and order, Minister of Public Security Luong Tam Quang said that the draft Law consists of 12 articles, of which 136/570 articles are amended and supplemented and 2 new articles are added to 10 laws related to security and order.

The draft Law amends and supplements a number of contents of 10 laws related to security and order affected by the results of the organizational restructuring. In addition, a number of other contents are amended and supplemented to meet urgent practical requirements, in line with the policy of breakthrough in science and technology development, innovation, national digital transformation, decentralization, delegation of power, reduction of administrative procedures and consistency with the legal system.

Regarding the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam, the draft Law amends and supplements regulations on: visa incentives and temporary residence cards for foreigners; temporary residence period of foreigners; authority to issue permanent residence cards; Vietnamese citizens permanently residing in the country are allowed to invite and sponsor foreigners who are grandchildren to enter Vietnam; authority to regulate the issuance and use of electronic identification for foreigners. At the same time, amend and supplement regulations of 3 administrative procedures to create more favorable conditions for agencies, organizations and individuals.

Regarding the Law on Exit and Entry of Vietnamese Citizens, the draft Law amends and supplements regulations on: validity of ordinary passports; cases where exit and entry documents have not been issued; cases where passports are revoked or invalidated; responsibilities for regulating the issuance of diplomatic notes to support visa applications. Amends and supplements regulations on 3 administrative procedures to create more favorable conditions for agencies, organizations and individuals.

Regarding the Law on Residence, the draft Law amends and supplements regulations on permanent and temporary residence registration for children under 6 years old; permanent residence registration for minors; cancellation of permanent and temporary residence registration when the decision to restore Vietnamese nationality is revoked; vehicle owners or persons assigned to manage vehicles are responsible for notifying residence. At the same time, the draft Law also amends and supplements regulations of 2 administrative procedures to create more favorable conditions for agencies, organizations and individuals.

Regarding the Law on Identification, the draft Law amends and supplements regulations on identification management agencies; revocation of identification cards; and the value of use of electronic identification.

Regarding the Law on Road Traffic Order and Safety, the draft Law amends and supplements regulations on: priority light signal colors for military vehicles; smart vehicles; types of vehicles that must be equipped with journey monitoring devices, driver image recording devices, passenger compartment image recording devices; responsibilities for regulations on standards, training and testing instructions.

The Draft Law also amends and supplements regulations on the responsibility of vehicle inspection establishments to refuse vehicle inspection; upgrading driving licenses; authority to regulate training, testing, granting, changing, re-granting, and revoking driving licenses for defense and security purposes; revoking driving licenses; and driving time of car drivers.

Regarding the Road Law, the draft Law amends and supplements regulations on road traffic safety inspection and assessment. The draft Law decentralizes and delegates 3 contents under the Prime Minister's authority to the Minister; 1 content under the Ministry of Construction's authority to the road management agency under the Ministry of Construction; 1 content under the provincial People's Committee's authority to the specialized agency under the provincial People's Committee.

Regarding the Law on Management and Use of Weapons, Explosives and Support Tools, the draft Law amends and supplements regulations on 11 administrative procedures to create more favorable conditions for agencies, organizations and individuals. Decentralizes and delegates 4 contents under the authority of the Prime Minister to the Minister; 1 content under the authority of the Minister to the People's Committee at the provincial level.

The Draft Law also clearly stipulates that journey monitoring devices and driver image recording devices installed in accordance with the provisions of the Law on Road Traffic Order and Safety shall continue to be used until December 31, 2029.

Regulations on the validity period of ordinary passports issued under the simplified procedure are more suitable

Briefly presenting the Review Report on the draft Law, Chairman of the National Defense, Security and Foreign Affairs Committee Le Tan Toi said that the Committee basically agreed with the adjusted contents in the draft Law, which focused on issues related to the arrangement of organizational apparatus, decentralization, delegation of power and removing difficulties, obstacles and "bottlenecks" caused by legal regulations and law implementation.

Regarding amendments and supplements to a number of articles of the Law on Exit and Entry of Vietnamese Citizens (Article 3), it is recommended to consider regulations on the validity of ordinary passports issued under simplified procedures for suitability, because this passport is only valid for one-time use when exiting or entering Vietnam; it is recommended to study specific regulations on canceling the validity of passports of wanted persons to be suitable for practice and ensure strictness.

Regarding amendments and supplements to a number of articles of the Law on Residence (Article 4), it is proposed to stipulate that minors are allowed to register permanent residence at a legal residence that is not their own when returning to their parents or guardians to ensure the right to legal residence of minors but not to infringe upon the legal residence of others without their consent; it is proposed to supplement similar provisions for people who have lost civil act capacity and people with difficulty in cognition and behavior control to be allowed to return to live with their guardians.

Regarding amendments and supplements to a number of articles of the Law on Identification (Article 5), it is proposed that the Minister of Public Security be assigned to regulate the agency managing identification in the People's Public Security to comply with the provisions of Article 18 of the Law on People's Public Security; it is proposed to stipulate more clearly the integration of information fields in electronic identification on the basis of national and specialized databases, to facilitate people when conducting transactions.

Regarding amendments and supplements to a number of articles of the Law on Road Traffic Order and Safety (Article 7): It is recommended to consider regulations on passenger transport vehicles that must be equipped with journey monitoring devices, devices to record images of the driver and images of the passenger compartment; consider regulations on driving time per day, per month, continuous driving, and minimum rest time for drivers to ensure feasibility; review and supplement regulations on technical safety and environmental protection certification for modified motor vehicles and modified specialized motorbikes accordingly.

Regarding amendments and supplements to a number of articles of the Law on Management and Use of Weapons, Explosives and Support Tools (Article 9): It is proposed to regulate the authority to equip military weapons for forces other than the Police and the Army accordingly; to regulate the permission for organizations other than the Police and the Army to dig and search for weapons and explosives; it is proposed to assign the Minister of Public Security or the Minister of National Defense to decide to ensure feasibility and avoid overlapping of functions and tasks.
