Cutting down on procedures, moving towards a modern and transparent digital administration

VHO - The Ministry of Justice has just requested ministries, branches and localities to complete the review and propose to reduce administrative procedures before November 15, aiming to form a mechanism where "state agencies can exploit information themselves, people do not have to submit it back".

According to data from the National Database on Administrative Procedures (AP) as of October 17th, there are currently 5,527 administrative procedures nationwide, including 3,170 at the ministerial or vertical agency level, 2,082 at the provincial level, 400 at the commune level, and 141 at other agencies.

In addition, there are 668 administrative procedures stipulated by local authorities to meet the specific policies of each locality.

Recently, the Ministry of Public Security, in coordination with consulting units, reviewed and identified 15 types of documents that already have complete data and can be automatically processed to reduce and simplify the components of administrative procedures. Based on this, the Ministry of Public Security compiled a detailed list of 734 administrative procedures whose components contain one of these 15 types of documents, which can be replaced by data.

To specifically implement Government Decree 06 on the development of population data, electronic identification and authentication, the Ministry of Justice 's Official Letter No. 6723, accompanied by three appendices, provides detailed guidance on review methods, summary forms, and five options for reducing and simplifying administrative procedures, aiming to ensure uniform implementation nationwide.

Accordingly, the review will focus on administrative procedures whose application files contain at least one of the 15 types of documents that can be replaced by data, based on the list compiled by the Ministry of Public Security.

The Ministry of Justice instructs agencies to choose one of five options when conducting reviews, specifically as follows:

Firstly , replace paper documents with electronic data. Government agencies will proactively search and access information in databases, instead of requiring citizens to provide paper documents.

Secondly , completely eliminate the required documents if the information is no longer necessary for processing the procedure.

Thirdly , if the information is still needed but cannot yet be replaced by data, the reasons must be clearly stated to provide a basis for further improvement.

Fourth , with overlapping or outdated procedures, it may be proposed to abolish all administrative procedures.

Fifthly , it is recommended that the ministries and agencies in charge of the databases provide additional necessary information fields to ensure the ability to connect, share, and utilize the data.

Ministries, ministerial-level agencies, provinces, and cities will enter the review results into the attached appendix. In case additional procedures that can be reduced are discovered, the units need to update and supplement them; if there is inconsistency with the published list, the reasons must be clearly stated.

During the review process, agencies must clearly specify the article, clause, point, form, or appendix of the legal document that needs to be amended or repealed.

If replacing records with data requires adjusting forms or declarations to include additional information for retrieval purposes, this must be specified in the report.

For specific administrative procedures issued by local authorities, the chairpersons of the People's Committees of provinces and cities are responsible for directing a review and proposing reductions, while also advising competent authorities to amend and supplement legal documents to eliminate the requirement for citizens to submit documents already available in the database. This must be completed before November 15th or presented at the nearest People's Council meeting.

According to Deputy Minister of Justice Nguyen Thanh Tinh, streamlining administrative procedures not only reduces compliance costs but also leads to reduced social costs, thereby allowing more resources to be focused on investment and development. At the same time, the efficiency and effectiveness of the administrative apparatus are enhanced, moving towards a modern, transparent administration that better serves development.

Deputy Minister Nguyen Thanh Tinh also emphasized that, in order for the reduction and simplification of administrative procedures based on data to be truly feasible and beneficial to citizens and businesses, ministries, sectors, and localities need to clarify their capacity and commitment in building, connecting, and sharing data according to the principles of "accurate, complete, clean, active, unified, and shared," to ensure that the reduction plan is effectively implemented as soon as it is issued.

This requires a synchronized and seamless information technology system, technical infrastructure, and terminal equipment; it also necessitates training and guidance for staff to ensure smooth operation.
