The Ministry of Finance said that the draft Decree was proposed to specifically guide Article 4 of Law No. 59/2024/QH15 - the Law assigning the Government to detail the funding, costs, and support for judicial activities for minors.
Clearly stipulate the contents of funding, costs, and support for judicial activities for minors and the responsibilities of competent agencies and individuals in ensuring funding, costs, and support for judicial activities for minors.
Content of state budget expenditure for juvenile justice activities
The Ministry of Finance said that Article 4 of the draft proposes to specify the contents of expenditure from the state budget for juvenile justice activities, ensuring the legal basis for ministries, central and local agencies in making estimates, managing, using and settling funds from the state budget for juvenile justice activities. For the contents in this article, the Ministry of Finance drafts on the basis of citing the expenditure contents prescribed in Article 4 of the Law on Juvenile Justice and referring to current regulations related to each expenditure content.
In addition, there are some new expenditure contents stipulated in Article 4 of the Law, which are specific to the sector (for example: Expenses for implementing the regime of food, clothing, accommodation, daily necessities, medical care; expenses for cultural study programs, career education, vocational training, labor, cultural activities, arts and entertainment for students of reform schools and juvenile prisoners...). The Ministry of Finance has sent a document to the Ministries (including the Ministry of Public Security ) requesting specific proposals on the content and level of expenditure; however, there has not been a specific proposal. Therefore, for now, in the draft, the Ministry of Finance proposes to regulate in the direction of: Implementing according to the expenditure norms issued by the Minister of Public Security, in accordance with the specific characteristics of the sector, the actual occurrence and in accordance with the psychological, physiological and developmental characteristics of minors.
Specifically, the proposed state budget expenditure for juvenile justice activities is as follows:
Expenses for ensuring facilities and purchasing equipment
The expenditure ensures facilities and purchases equipment to carry out friendly proceedings for minors. Specifically, the expenditure ensures facilities specifically for minors such as: Friendly trial rooms, functional rooms (Diversionary measures room; statement recording room; Friendly investigation room at commune-level police; medical care support room; psychological counseling room when minors participate in proceedings; isolation room for participants in proceedings).
The branch ensures facilities and purchases equipment to implement electronic monitoring measures.
The branch ensures the facilities of reform schools, separate detention camps, sub-camps, and detention areas reserved for minors.
The implementation content is as follows:
Expenditure from public investment capital sources: Implemented according to the provisions of the Law on Public Investment and guiding documents.
Expenditure from regular state budget expenditure sources: Implemented according to the provisions of Decree No. 98/2025/ND-CP dated May 6, 2025 of the Government stipulating the preparation of estimates, management, use and settlement of regular state budget expenditures for purchasing, repairing, renovating, upgrading assets and equipment; spending on renting goods and services; repairing, renovating, upgrading, expanding, and constructing new construction items in invested construction projects and other necessary tasks and other relevant legal documents.
In addition, expenses for food, clothing, accommodation, daily necessities, medical care; expenses for cultural programs, career education, vocational training, labor, cultural activities, arts and entertainment for students of reform schools and juvenile prisoners: Implement according to the spending norms issued by the Minister of Public Security, in accordance with the characteristics of the industry, actual occurrence and in accordance with the psychological, physiological and developmental characteristics of juveniles.
Expenditure of the Children's Support Fund for juvenile justice activities: Implemented according to the Government's Decree guiding Article 160 of the Law on Juvenile Justice and regulations of the Children's Support Fund.
Costs for social workers participating in litigation
Expenses for social workers participating in litigation, people directly supervising the implementation of decisions to apply diversion measures, people assigned to help minors reintegrate into the community; expenses for medical, psychological, educational, sociological experts, representatives of educational institutions, vocational training institutions, representatives of the Vietnam Fatherland Front Committee, member organizations of the Front and other agencies, organizations and individuals participating in the process of resolving cases and lawsuits at the request of competent agencies and persons are proposed as follows:
Travel and accommodation expenses for social workers and supervisors: Implemented according to current business expense regime.
Expenses for medical, psychological, educational, sociological experts, representatives of educational institutions, vocational training institutions, representatives of the Vietnam Fatherland Front Committee, member organizations of the Front and other agencies, organizations and individuals participating in the process of resolving cases and lawsuits at the request of competent agencies and individuals: To be decided by competent agencies and individuals resolving cases and lawsuits in accordance with reality, within the scope of the allocated budget.
Expenses for training and professional development for social workers and those directly supervising the implementation of decisions on applying diversionary measures: Implement according to the regulations of the Ministry of Finance on expenses for training and development of cadres, civil servants and public employees.
In addition, other contents for juvenile justice activities guaranteed by the state budget according to relevant laws are proposed to be spent in the draft as follows:
The branch organizes conferences to propagate, disseminate and thoroughly understand the Law on Juvenile Justice and guiding documents; the branch organizes training courses on juvenile justice; trains friendly investigation skills in cases related to juveniles; provides professional training on juvenile criminal psychology for officers of detention camps, prisons, investigators, prosecutors and judges: Implement according to the regulations of the Ministry of Finance on conference expenditure regime.
Expenses for providing legal aid to minors: Implement according to the provisions of the Law on Legal Aid and guiding documents.
Interpretation and translation costs for minors who are ethnic minorities or have special needs: Implement according to the provisions of the Ordinance on Litigation Costs and guiding documents.
Other contents related to juvenile justice activities: Business expenses for litigants participating in investigations, interrogations, confrontations, and crime scene examinations; expenses for investigation, investigation supervision, and prosecution; expenses for protection and support of witnesses and victims: Implemented according to current legal provisions on investigation and litigation activities.
