At the Government's special session on law-making in April 2025, the Government discussed and gave opinions on 06 Draft laws and resolutions to submit to the National Assembly in order to promptly institutionalize the Party's policies and guidelines on the arrangement and organization of the apparatus of the political system in conjunction with the amendment and supplementation of the 2013 Constitution; promptly remove obstacles and shortcomings caused by legal regulations, continue to promote decentralization, delegation of power, simplify administrative procedures, create conditions for business investment, create a complete legal corridor for new issues and new trends to promote growth to reach the target of 8% in 2025, creating a solid foundation for achieving double-digit growth.

The Government highly appreciates the Ministries of Public Security, Justice, Finance, and Construction for promptly preparing and submitting to the Government the following projects: (1) Penal Code (amended), (2) Law on Organization of Criminal Investigation Agencies (amended), (3) Law on Amending and Supplementing a Number of Articles of the Law on Handling of Administrative Violations, (4) Law on Amending and Supplementing a Number of Articles of the Law on Nationality, (5) Resolution of the National Assembly on the construction of a Regional and International Financial Center in Vietnam, (6) Resolution of the National Assembly on piloting a number of specific mechanisms and policies for the development of social housing . Relevant ministries and agencies have actively contributed opinions and completed the draft laws and resolutions with a high sense of responsibility.

Responding to the requirements of crime prevention and control in the new situation

Regarding the Draft Penal Code (amended), the Government basically agrees with the content of the draft Penal Code (amended) submitted by the Ministry of Public Security in Submission No. 164/TTr-BCA. day 10 April 2025. Assign the Ministry of Public Security to preside over and coordinate with relevant ministries and agencies to study and absorb as much as possible the opinions of Government members and opinions at the Government meeting, promptly complete the draft dossier of the Penal Code (amended), ensuring the following requirements:

Study and carefully consider the scope of amendments and supplements; select urgent and inadequate issues of the current Penal Code to have optimal, appropriate and effective solutions to promptly amend and supplement a number of articles according to the direction of the Politburo, meeting the requirements of fighting and preventing crime in the new situation.

Review, research, and ensure that amendments and supplements do not criminalize economic and civil relations. Further evaluate the advantages, disadvantages, and impacts of expanding the scope of criminal liability of commercial legal entities and increasing the fixed-term prison sentence to 30 years and adding life imprisonment without parole.

The Ministry of Public Security is responsible for the content of the acceptance and completion of the draft Penal Code (amended); proactively reporting and explaining during the review process, accepting the opinions of the National Assembly Standing Committee on the draft Code. On the basis of accepting and completing the draft Penal Code (amended), the Minister of Public Security is assigned, on behalf of the Prime Minister, to sign the Government's Submission on the draft Penal Code (amended) and submit it to the National Assembly.

Regarding the Draft Law on Organization of Criminal Investigation Agencies (amended) (combining amendments and supplements to a number of articles of the Law on Enforcement of Criminal Judgments and amendments and supplements to a number of articles of the Law on Prevention and Combat of Human Trafficking) , the Government basically agrees with the content of the draft Law on Organization of Criminal Investigation Agencies (amended) submitted by the Ministry of Public Security in Submission No. 162/TTr-BCA. day 10 April 2025. Assign the Ministry of Public Security to preside over and coordinate with relevant ministries and agencies to study and absorb as much as possible the opinions of Government members and opinions at the Government meeting, promptly complete the dossier of the draft Law on Organization of Criminal Investigation Agencies (amended), ensuring the following requirements:

Research and consider the scope of amendments and supplements; focus on amending and supplementing a number of articles of the Law on Organization of Criminal Investigation Agencies. current, ensuring compliance with the Party's viewpoints and directions and requirements for restructuring the apparatus as prescribed in Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling a number of issues related to restructuring the state apparatus.

The Ministry of Public Security is assigned to carefully review the resolutions and conclusions of the Politburo and the Central Committee related to the Investigation Agency of the Supreme People's Procuracy. The non-organization of the Investigation Agency of the Supreme People's Procuracy is not contrary to the resolutions of the Politburo and the Central Committee. The Government agrees with the non-organization of the Investigation Agency of the Supreme People's Procuracy in accordance with the provisions of the Constitution. In case the National Assembly has a different opinion, the Government Party Committee will agree with the National Assembly Party Committee to report to request opinions from competent authorities.

The Ministry of Public Security is responsible for the content of the acceptance and completion of the draft Law on Organization of Criminal Investigation Agencies (amended); proactively reporting and explaining during the process of examining and accepting opinions of the National Assembly Standing Committee on the draft Law. On the basis of acceptance and completion of the draft Law on Organization of Criminal Investigation Agencies (amended), the Minister of Public Security is assigned, on behalf of the Prime Minister, to sign the Government's Submission on the draft Law on Organization of Criminal Investigation Agencies (amended) and submit it to the National Assembly.

Prioritize the revision of urgent issues related to the organization and apparatus arrangement.

Regarding the Draft Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations, the Government basically agrees with the content of the draft Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations submitted by the Ministry of Justice in Submission No. 46/TTr-BTP dated April 10, 2025. The Ministry of Justice is assigned to preside over and coordinate with relevant ministries and agencies to study and absorb as much as possible the opinions of Government members and opinions at the Government meeting, promptly complete the draft Law dossier, ensuring the following requirements:

The draft Law only stipulates the contents under the authority of the National Assembly, assigning the Government to stipulate specific, detailed, specialized contents; only focusing on and prioritizing amendments to urgent issues related to the organization and apparatus arrangement. Continue to coordinate with relevant ministries and agencies and consult experts, study international experiences to complete the draft Law. Review and research to stipulate increased penalties for some administrative violations in the fields of environment, fire prevention and fighting... to ensure compliance with socio-economic development conditions.

Regarding the handling of seized exhibits and means of administrative violations: Agree with the draft Law on the proposed direction of supplementing provisions allowing timely handling of seized exhibits and means of administrative violations when the detention period expires but the violator, owner, manager or legal user does not come to receive them and the violator, owner, manager or legal user of the exhibits and means cannot be identified to avoid damage and waste of assets; ensure the rights and interests of related parties, and avoid social waste.

The Ministry of Justice is responsible for the content of the acceptance and completion of the draft Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations; proactively reporting and explaining during the process of examining and accepting opinions of the National Assembly Standing Committee on the draft Law. On the basis of acceptance and completion of the draft Law, the Minister of Justice is assigned, on behalf of the Government, to sign the Government's Submission on the draft Law and submit it to the National Assembly.

The Government assigned Deputy Prime Minister Le Thanh Long to direct the revision and completion of the draft Law.

Regarding the Draft Law amending and supplementing a number of articles of the Law on Vietnamese Nationality , the Government requests to amend and supplement a number of regulations related to the return to Vietnamese nationality of Vietnamese people residing abroad, ensuring consistency with the Party and State's guidelines and policies towards Vietnamese people residing abroad while attracting talents, experts, scientists, investors, businessmen, and Vietnamese people living abroad who have a heart for their homeland and country; continue to research and inherit and perfect the principle of one nationality in accordance with the new situation and conditions at home and abroad, ensuring the absolute sovereignty of the Vietnamese State over Vietnamese nationality.

Agree to supplement regulations on nationality conditions (Clause 5, Article 5 of the draft Law) and supplement regulations on the Government's authority to determine Vietnamese nationality for children whose births have been registered at competent foreign authorities (Clause 2, Article 16 of the draft Law).

Continue to review and minimize unnecessary administrative procedures, ensure publicity and transparency, shorten processing time of competent authorities, focus on promoting digital transformation to effectively apply in the process of handling applications for re-acquiring Vietnamese nationality.

The Ministry of Justice is responsible for the content of the acceptance and completion of the draft Law amending and supplementing a number of articles of the Law on Vietnamese Nationality; proactively reporting and explaining during the process of examining and accepting opinions of the National Assembly Standing Committee on the draft Law. On the basis of acceptance and completion of the draft Law, the Minister of Justice is assigned, on behalf of the Government, to sign the Government's Submission on the draft Law and submit it to the National Assembly.

The Government assigned Deputy Prime Minister Le Thanh Long to direct the revision and completion of the draft Law.

2 Draft Resolutions of the National Assembly

Regarding the National Assembly's Draft Resolution on the construction of a regional and international financial center in Vietnam , the Government assigned the Ministry of Finance to preside over and coordinate with ministries, agencies, the People's Committee of Ho Chi Minh City and the People's Committee of Da Nang City to study and receive opinions from Government members to promptly complete the dossier for submission of the draft Resolution of the National Assembly to ensure feasibility and effectiveness. On that basis, the Minister of Finance is assigned to, on behalf of the Prime Minister, report to the National Assembly and the National Assembly Standing Committee as prescribed; and is responsible for reporting and explaining to the National Assembly and the National Assembly's agencies as prescribed.

The Government assigned Permanent Deputy Prime Minister Nguyen Hoa Binh to direct the revision and completion of the draft Resolution.

Regarding the Draft Resolution of the National Assembly on piloting a number of specific mechanisms and policies for social housing development , the Government assigned the Ministry of Construction to preside over and coordinate with relevant ministries and agencies to study and absorb as much as possible the opinions of Government members and opinions at the Government meeting, promptly complete the draft Resolution dossier, ensure close adherence to and full institutionalization of the policies that the Politburo has agreed to issue in principle the Pilot Resolution on a number of specific mechanisms and policies for social housing development in Document No. 13848-CV/VPTWD dated March 18, 2025 on the basis of the proposal of the Government Party Committee in Document No. 121-CV/DU dated March 6, 2025 and Document No. 138-CV/DU dated March 12, 2025 on approving the policy to issue the Pilot Resolution on a number of specific mechanisms and policies for social housing development. in society

The Ministry of Construction is responsible for the content of receiving and completing the dossier and draft Resolution of the National Assembly; proactively reporting and explaining during the process of examining and receiving opinions of the National Assembly Standing Committee on the dossier and draft Resolution. The Minister of Construction is assigned, on behalf of the Prime Minister, to sign the Government's Submission on the draft Resolution on piloting a number of specific mechanisms and policies for social housing development, and submit it to the National Assembly for consideration, comments and approval at the 9th Session of the 15th National Assembly.

The Government assigned Deputy Prime Minister Tran Hong Ha to direct the revision and completion of the draft Resolution.
