The self-demolition of the illegal construction from the morning of March 12 until now, the construction owner did not submit a petition or report to the local authorities but carried out the above-mentioned demolition himself.
Talking to Nguoi Dua Tin , Mr. Le Trong Dai, the owner of the above project, said that he had borrowed several hundred billion to buy land and then completed all procedures to apply for a construction permit but was rejected, so he took the risk. Moreover, I had been allowed to change the land use purpose to residential land of 300m2, so I just built, now I have to dismantle and accept bankruptcy.
"Since yesterday, we have had workers use specialized machinery to dismantle the roof frame. Workers are still working hard to restore the pillars to their original state and are expected to complete this March," Mr. Dai informed.
The owner of the illegal construction in Phu Quoc city voluntarily dismantled it.
As reported, on January 31, 2024, Phu Quoc City People's Committee issued Administrative Penalty Decision No. 353/QD-XPHC against Mr. Le Trong Dai (born in 1982, residing in Ho Chi Minh City).
According to the content of the Decision on sanction, Mr. Dai committed an administrative violation: converting perennial crop land to non-agricultural land for production and business (commercial and service land) in an urban area with an area of 461.3 m² without permission from the competent State agency at land plots No. 423, 424, 426, map sheet No. 122, land location Group 3B, Quarter 1, Duong Dong Ward (Phu Quoc City).
Currently, 18 reinforced concrete column foundations and floors have been built on the land with a construction area of 461.3m².
Specifically, the above construction project with 3 land plots was granted a land use right certificate by the Department of Natural Resources and Environment of Kien Giang province on May 18, 2018, with Mr. Mai Van Son and Ms. Tran Thanh Thuy as the owners, and was transferred to Mr. Le Trong Dai's name by the City Land Registration Office Branch on January 11, 2024, including:
Land plot number 423, map sheet number 122, area 500.5m², land type: land for perennial crops according to land use rights certificate number CM 626805.
Land plot number 424, map sheet number 122, area 500.2m², land type: land for perennial crops according to land use rights certificate number CM 626806.
Land plot number 426, map sheet number 122, area 500.2m², land type: land for perennial crops according to land use rights certificate number CM 626808.
Accordingly, Mr. Dai was fined 14.5 million VND and forced to restore the original condition of the land before the violation for the land area of 461.3m² at plots 423, 424, 426, map sheet 122 in group 3B, quarter 1, Duong Dong ward according to the Minutes of measurement and inspection of the current status made on January 22, 2024 of the People's Committee of Duong Dong ward, stipulated in Point a, Clause 4, Article 11 of Decree No. 91/2019/ND-CP.
In addition, Mr. Le Trong Dai was forced to return the illegal profits gained from converting perennial crop land to non-agricultural land for production and business (commercial and service land) in urban areas in the amount of VND 3,776,316 according to the provisions of Point c, Clause 4, Article 11 of Decree No. 91/2019/ND-CP.
