At the 10th session of the 15th National Assembly, contributing comments to the draft Law on Press (amended), delegate Le Nhat Thanh - National Assembly Delegation of Hanoi City said that it is necessary to have more specific regulations on the cases of revoking press operation licenses. Specifically, Clause 1, Article 20 of the draft states that "Press agencies with press operation licenses but not operating, the license will expire". Regarding this content, the delegate suggested that it is necessary to clearly state "how long does it take to not operate" for the license to expire to ensure transparency.
At the same time, it is necessary to supplement the principled provisions on cases where press agencies must temporarily suspend operations due to objective reasons (organizational restructuring) or force majeure (epidemics, etc.). In these cases, the suspension period should not be considered as a basis for determining the expiration of the license, in order to avoid unnecessary administrative procedures.

According to the draft Law, people working at scientific journals are not eligible for press cards (point e, clause 1, Article 29). Delegates believe that this provision is a change from the 2016 Press Law and may lead to inequality between people working at scientific journals and other types of journals. Delegates suggest that the drafting agency continue to research, evaluate and consider keeping the provision on granting press cards to people working at scientific journals as the current provision of the 2016 Press Law.
Regarding copyright in the field of journalism (Article 39), the draft Basic Law inherits current regulations, requiring press agencies to comply with the law on copyright and related rights when publishing and broadcasting press works. However, delegates said that this regulation only stops at citing but does not clarify the legal responsibilities of press agencies, especially in the context of increasingly popular application of artificial intelligence (AI).
Therefore, delegate Le Nhat Thanh suggested that the Drafting Committee study and supplement specific regulations on the responsibility of press agencies in controlling the origin and legality of press works, including when using AI to support content creation.

Commenting on the draft Law, delegate Tran Thi Thu Dong - National Assembly Delegation of Ca Mau province said that adding regulations on "key multimedia communication agencies" is the right direction, but still lacks specific content and financial resources to ensure implementation. If the criteria for determining the key agencies are not clarified, the application of special financial mechanisms may be unfair...
Delegates suggested that the Government establish specific criteria (such as coverage area, human resources capacity, ability to lead public opinion...) and present a plan to mobilize capital sources, ensuring feasible policies. At the same time, it is necessary to review the consistency between the Press Law and related laws such as the Law on Corporate Income Tax, the Law on Public Asset Management... to avoid overlap.
Regarding the development of digital journalism, delegate Tran Thi Thu Dong said that the concept of "national digital journalism platform" needs to be clarified: if it is a shared infrastructure, it is appropriate; but if it is a platform for distributing exclusive content, it will limit competition and creativity. This should be considered a tool to support data and prevent fake news, instead of a content distribution mechanism. At the same time, it is necessary to supplement regulations on copyright of press works using artificial intelligence (AI), protect author rights, encourage innovation, etc.
Delegate Nguyen Huy Thai - National Assembly Delegation of Ca Mau province proposed to add a separate provision on local press agencies, performing the function of the local Party Committee, government and people, ensuring that the voice accompanies the leadership and direction of the Party Committee and government. This regulation should closely follow the Regulation No. 373-QD/TW of the Politburo that has just been issued.
In particular, delegates recommended clarifying sanctions for acts of taking advantage of social networks to impersonate press agencies, clearly defining the authority to revoke domain names, impose penalties and publicize the results of handling, in order to prevent the situation of "fake journalism" spreading in cyberspace.
