The Ho Chi Minh City People's Committee has just issued Document No. 588/TB-VP announcing the conclusion of Chairman of the Ho Chi Minh City People's Committee Phan Van Mai at the 3rd meeting of the working group to remove difficulties and obstacles for investment projects in the city (referred to as the working group).

More than 40 projects that do not meet the conditions for land use rights are proposed to be converted into social housing projects.

According to the conclusion announcement, for 41 projects that do not meet the conditions for having the right to use residential land to be approved for investment policy to implement commercial housing projects, the Chairman of the Ho Chi Minh City People's Committee assigned the Department of Planning and Investment to review, work with and notify investors that they do not have the right to use residential land within the project boundary, so they do not meet the legal basis to carry out procedures for approving investment policy for commercial housing projects.

At the same time, guide the implementation of investment according to the proposed plans to change the target from investment in commercial housing construction to investment in social housing construction.

In case the investor still wishes to continue investing in the commercial housing project, the investor is requested to study the option of selecting an investor for the commercial housing project through bidding to select an investor according to regulations.

The Department of Planning and Investment provides detailed instructions on the bidding process and procedures for selecting investors in accordance with regulations.

Regarding 5 projects that are being resolved by the working group and the Departments have not yet commented according to the direction of the Head of the Working Group, including: project No. 3A-3B Ton Duc Thang of Phuong Nam 3A-2 Real Estate Trading Joint Stock Company, Le Thanh apartment project of Le Thanh Trading - Construction Company Limited, Tam Dai Thanh low-rise housing project of Tam Dai Thanh Cong Real Estate Company Limited, Moonlight Centre Point housing project in the city center (Moonlight Centre Point) of Vinh Tien Real Estate Joint Stock Company and NBB Garden III residential project of Nam Bay Bay Investment Joint Stock Company.

The Chairman of the Ho Chi Minh City People's Committee assigned the Department of Natural Resources and Environment, the Department of Construction, the Department of Planning and Architecture, the People's Committees of District 8 and Binh Tan District to urgently and seriously implement the instructions in the previous notice (Notice 539/TB-VP), and send written comments to the Department of Planning and Investment before August 10, 2023 for synthesis, appraisal and submission to the Ho Chi Minh City People's Committee for consideration and decision before August 15, 2023, without delay.

In addition, the Ho Chi Minh City People's Committee assigned the Department of Planning and Investment to guide the investor to supplement the project's legal documents and give an opinion on whether or not to carry out the investment policy approval procedure for the project of the Commercial, Service, Office and Apartment Complex at land plot No. 18, map No. 1, 3/2 Street (District 11) to send to the Department of Construction before August 15, 2023 to serve as a basis for granting a construction permit for the project.

For the Co Giang apartment project (District 1), the Department of Construction is assigned to coordinate with the Department of Natural Resources and Environment and relevant units to urgently identify the area exempted from land use fees according to regulations, to be implemented before August 15, 2023.

For the investment project to build a complex of apartments combined with trade - services - hotels - officetels on Nguyen Tat Thanh Street (District 4), the Department of Natural Resources and Environment, the Department of Planning and Investment, and the Department of Enterprise Finance are assigned to send their opinions to the Department of Construction to synthesize a report to request the Prime Minister's opinion before August 10, 2023.
