(Dan Tri) - National Assembly delegates proposed adding a mechanism to allocate bonus funds based on work performance, giving autonomy to units in allocation but must be public and linked to the results of annual civil servant evaluations.

The draft Law on Civil Servants (amended) was commented on by National Assembly deputies at the Conference of specialized National Assembly deputies on the morning of October 1.

Commenting on the draft law expanding the scope of salary sources not only from the salary fund of public service units but also including other legal sources of income, delegate Thach Phuoc Binh ( Vinh Long ) assessed this as an important step forward, creating conditions for civil servants to enjoy more diverse income.

However, the delegate commented that the draft law needs to clarify the mechanism for transparently allocating revenue sources as well as how to ensure benefits for civil servants working in units with different conditions.

"If there are no specific regulations, there could be a huge income gap, causing unfairness," Mr. Binh worries.

Delegates from Vinh Long province proposed that the draft law supplement the principle of fair distribution linking increased income with work efficiency and stipulate the obligation to publicly disclose financial transparency to ensure fairness among units.

Also related to the issue of salary and bonus, the draft law stipulates in the direction of linking income with work results and efficiency, in line with the trend of paying salary according to job position.

According to delegate Thach Phuoc Binh, it is necessary to clarify the bonus mechanism and clearly distinguish between basic salary and additional income, because if the regulations are general, units will have difficulty in building internal spending regulations, which can easily lead to complaints and disputes.

The delegate proposed adding a mechanism to allocate bonus funds based on work performance, giving autonomy to units in allocation, but it must be public, transparent, and linked to the results of annual civil servant evaluations.

The draft revised Law on Public Employees regulates the management of public employees according to the principle of empowering with accountability and encouraging public employees to innovate and be creative.

Acknowledging these as progressive regulations, Mr. Binh said there is still a lack of mechanisms to protect civil servants in cases where innovation and creativity do not yield the desired results.

In fact, he said many officials are afraid of risks and innovation because they are afraid of being held responsible. Therefore, it is necessary to legislate a mechanism to exempt or reduce responsibility for officials who dare to think and act for the common good but do not bring results.

A new content of this draft law is to allow civil servants to sign labor contracts and participate in the management and operation of non-public enterprises if it is not against the law.

Delegate Thach Phuoc Binh suggested that the bill should clearly stipulate the list of fields and occupations that civil servants are allowed to participate in, and at the same time require transparent reporting and supervision by the management unit. “If not strictly controlled, it will lead to conflicts of interest, civil servants can take advantage of their positions to serve personal interests,” Mr. Binh worried.

Regarding civil servant recruitment, the draft law changes the basis for recruitment based on job position, salary fund and legal income source, instead of only relying on job title as in current law.

Delegates from Vinh Long province said that this new regulation can help select civil servants close to the needs, but in reality, recruitment is still heavy on administrative procedures and not flexible enough to attract talent.

Therefore, according to Mr. Binh, it is necessary to expand the mechanism for directly receiving experts, scientists , and talents, and to boldly decentralize further so that public service units have real autonomy in recruitment, associated with accountability.

To clarify the content that National Assembly deputies are concerned about regarding the regulations on exemption of responsibility for civil servants when implementing innovation and creativity but there may be unexpected risks even if following the correct procedures, Deputy Minister of Home Affairs Truong Hai Long, Clause 8, Article 11 of the draft law clearly stated that civil servants are considered for exclusion or exemption from responsibility according to the provisions of law and of competent authorities.

This issue has also been agreed upon by the Politburo and stated in a number of specialized laws. However, taking into account the opinions of delegates, the drafting agency will review to specifically institutionalize exemptions in which cases.

Regarding recruitment, Deputy Minister Truong Hai Long emphasized the direction of innovation in management according to job positions to improve quality as well as restructure the staff.

Regarding contracts for civil servants, Deputy Minister Long affirmed that this is very important content, because when recruited, civil servants must exercise all rights, obligations and responsibilities according to the contract.

“The Law on Civil Servants stipulates labor contracts and service contracts to ensure flexibility and rights of civil servants when signing work contracts,” the leader of the Ministry of Home Affairs emphasized.

Deputy Minister Truong Hai Long affirmed that the drafting agency will accept comments to perfect the control, supervision and accountability mechanism, avoiding abuse of power when performing professional activities.

The draft revised Law on Civil Servants, consisting of 6 chapters and 43 articles (19 articles less than the current Law), will be considered and approved by the National Assembly at the 10th session.
