Analyzing in depth the group of recruitment principles, Delegate Pham Thi Minh Hue, National Assembly Delegation of Can Tho City , said that the draft law still has inconsistencies between Article 16 and Article 3. The delegate cited: “Clause 4 of Article 3 stipulates preferential policies for talented people, but Clause 5 of Article 16 does not mention it. Recruitment principles that lack the group of 'talented people' are not consistent with the strategic orientation of attracting high-quality human resources.”

According to the Delegate, the lack of consistency within the draft law makes it easy for enforcement agencies to be confused and create loopholes in law application.

Need to standardize recruitment process

According to Quochoi.vn, one of the contents that many Delegates are interested in is the regulation in Article 18 on the authority to recruit civil servants. According to Deputy Pham Thi Minh Hue, National Assembly Delegation of Can Tho City: "The draft Law allows public service units to have the authority to recruit but can propose to superior agencies to recruit on their behalf. If it is not clearly defined which cases can be proposed and which cases must be implemented by themselves, it will easily lead to arbitrary application."

Delegates also warned of the risk of creating a legal “gray zone” such as hiring those who like it and pushing them to higher levels. This could lead to a situation of avoiding responsibility, reducing the initiative of public service units.

Regarding the regulations on recruitment according to job positions, Delegate Pham Van Hoa, National Assembly Delegation of Dong Thap province, highly appreciated the approach in the draft Law. According to the Delegate, this is a modern way of doing things, eliminating the previous formal recruitment method based on the payroll. The Delegate analyzed: "Previously, if there was a shortage of payroll, recruitment would be done that year, and then the work would be assigned to the unit, leading to the arrangement of non-specialized personnel. Now, the draft regulation on recruiting the right positions such as accounting, clerical or specialized in each field is very correct."

The Delegate pointed out: "Engagement or recruitment must be public and transparent. If not well controlled, it is easy to return to the situation of recruiting relatives and acquaintances, which is unfair in competition."

Raising the issue of standardizing and modernizing the recruitment process, Delegate Nguyen Tam Hung, Ho Chi Minh City National Assembly Delegation proposed: "It is necessary to clearly stipulate that civil servant recruitment exams are conducted centrally, applying digital technology, connecting national data on civil servants to control input quality and avoid double recruitment."

This is also an important solution in the context of many places organizing small-scale examinations, which can easily lead to negativity.

Commenting on the regulations on the selection mechanism, especially for nominated students, Delegate Dang Bich Ngoc, National Assembly Delegation of Phu Tho province pointed out the long-standing problem that many localities send students to study under the selection system but when they graduate, they do not have recruitment needs. "Selection must be linked to the local job position needs. The State spends training funds but students do not have jobs after graduation, which is a huge waste." The delegate pointed out and suggested that the draft law should include the principle: Localities can only send students to study when clearly identifying human resource needs; students must commit to serving the locality after graduation and recruitment quotas should be prioritized for the nominated subjects.

Commenting on the regulations on preferential policies for recruiting civil servants, Delegate Pham Van Hoa, National Assembly Delegation of Dong Thap province, frankly shared that if the law only stipulates priority for people with meritorious services or officers and professional soldiers in recruitment, it is no longer appropriate because the number of these forces is not large. In addition, he proposed to prioritize the recruitment of relatives of these forces to expand humane policies. The delegate proposed: "People with meritorious services or officers are old, and their health is no longer suitable for recruitment into civil servants. Therefore, we should add preferential policies for relatives of martyrs and wounded soldiers to both demonstrate humanity and ensure professional requirements."

"Children of ethnic minorities in remote areas, especially difficult areas really need priority mechanisms to ensure local human resources," the delegate shared.

The delegate also analyzed the current situation, many candidates from other places come to difficult areas, only work for a short time and then ask to transfer jobs, causing a long-term shortage of human resources. Therefore, the law needs to clearly state special priority subjects including ethnic minorities in remote areas; extremely difficult areas; ethnic minorities with very few people.
