Proposal to exempt and reduce land rent for digital technology, production and social security projects

On the morning of April 26, at the 44th Session, the National Assembly Standing Committee gave opinions on other cases of exemption or reduction of land use fees and land rents as prescribed in Clause 2, Article 157 of the 2024 Land Law. The Government proposed many new groups of preferential policies, especially to promote investment in the digital technology industry and support production and social security sectors.

At the meeting, Minister of Finance Nguyen Van Thang said that the Government proposed 12 policies, including:

Exemption and reduction of land rent for land belonging to units: institutes, innovation centers, research and development of digital technology .

At the same time, this policy also exempts land rent for projects producing key digital technology products, software products, semiconductor chips, artificial intelligence; concentrated digital technology zones, National Innovation Center; for land for building scientific research facilities of science and technology enterprises if meeting related conditions (if any) including: Land for building laboratories, land for building technology incubators and science and technology enterprise incubators, land for building experimental facilities, land for building experimental production facilities.

The reason for the policy proposal is that the draft Law on Digital Technology Industry, which is being developed, has provided regulations related to investment policies, support, and incentives for projects and enterprises, aiming to create a breakthrough in this field. Therefore, adding the above-mentioned subjects to enjoy the policy of land rent exemption and reduction will help enterprises, organizations, and investment projects in the digital technology industry develop, support the effective digital transformation process, and create a driving force to promote economic and social development.

The land rent reduction policy will be one of the factors supporting businesses in difficult times, creating growth momentum and opportunities to supplement capital for investment in production and business. This is also a policy to institutionalize the Party's policy on digital technology industry into socio-economic activities, especially Resolution No. 57-NQ/TW dated December 22, 2024 of the Politburo on breakthroughs in science, technology, innovation and national digital transformation; at the same time, to meet the requirements of innovation development in the new period, it is necessary to develop policies to promote the development of the digital technology industry.

On behalf of the auditing agency, Chairman of the Economic and Financial Committee Phan Van Mai said that the majority of opinions basically agreed on the necessity of issuing regulations on other cases of exemption or reduction of land use fees and land rents as stated in the Government's Proposal.

However, there are opinions that Clause 2, Article 157 only stipulates cases other than those stipulated in Clause 1, which are special and specific cases. Therefore, the Government's regulations on exemption and reduction of land use fees and land rents as stated in the Proposal are too broad.

Regarding the policies proposed in the Government's Proposal, the majority of opinions basically agree with other cases of exemption or reduction of land use fees and land rent. However, it is recommended to review the policies to ensure compliance with the principles stated.
