The Ministry of Construction has just announced a draft decree to replace Decree 100/2024/ND-CP on social housing. This draft has some proposed amendments to the income level conditions for enjoying social housing policies.

Buying social housing: Opportunity for couples with total income under 40 million VND
The subjects include low-income people in urban areas; workers and laborers working at enterprises, cooperatives, and cooperative unions inside and outside industrial parks; cadres, civil servants, and public employees according to the provisions of the law on cadres, civil servants, and public employees.
In case the applicant is not married or divorced but not remarried or is confirmed as single, the income must not exceed 20 million VND/month (currently 15 million VND/month).
In case the applicant is married according to the law, the total income of the husband and wife must not exceed 40 million VND/month.
In case of being unmarried or divorced but not remarried or confirmed as single and raising children under the age of majority, the income must not exceed 30 million VND/month.
Income level is calculated according to the salary and wage table confirmed by the agency, enterprise, or unit where the employee works.
The time for determining income conditions is within 12 consecutive months, calculated from the time the subject specified in this clause submits a valid application to the investor to register to buy or lease-purchase social housing.
The Ministry of Construction also proposed to revise the interest rate for loans to buy social housing through the Policy Bank to 5.4%/year (instead of the current 6.6%/year).
Previously, at the mid-August review conference on social housing development, Prime Minister Pham Minh Chinh basically agreed with the proposals and recommendations, including the proposal of the Ministry of Construction on raising the income threshold to buy social housing in a more appropriate direction, and assigned the Ministry of Construction to propose amendments in a shortened order to Decree 100/2024/ND-CP of the Government detailing a number of articles of the Housing Law on the development and management of social housing.
Hand over to the commune police to confirm the income of freelance workers to buy social housing.
Notably, in this draft, the Ministry of Construction proposed to amend and supplement Clause 1 and Clause 2, Article 30 on income conditions. Specifically, in case the subject specified in Clause 5, Article 76 of the Housing Law does not have a labor contract, he/she must ensure the income conditions as prescribed in Clause 1 of this Article and be confirmed by the police agency at the commune level where he/she permanently/temporarily resides instead of the People's Committee at the commune or ward level where he/she is registered for permanent or temporary residence as currently.
Within 7 days from the date of receiving the application, the commune-level police will base on information on the national population database to confirm the income conditions for the people.
The Ministry of Construction will amend and supplement the forms of documents proving and confirming conditions to ensure consistency with the above regulations.
Explaining this proposal, the Ministry of Construction said that the Ministry has received many recommendations and reflections from a number of localities about difficulties in confirming income conditions for low-income people in urban areas without labor contracts because the People's Committees at the commune level do not have information and data on the population to serve as a basis for confirmation. Previously, in document No. 120 (March 2025), the Government Office announced the Prime Minister's conclusion at the National Online Conference on removing difficulties and developing social housing, in which it assigned the Ministry of Public Security to innovate the population database, supplement information to assess people eligible to buy or rent-purchase social housing, in order to reduce administrative procedures.
Therefore, the Ministry of Construction proposes that in the case of low-income people in urban areas without a labor contract, they must ensure income conditions according to regulations and be confirmed by the police agency at the commune level where they permanently/temporarily reside or where they currently reside.
