The Government Office said that the issuance of the Decree replacing Decree No. 61/2018/ND-CP of the Government on implementing the one-stop, one-stop mechanism in handling administrative procedures and Decree No. 107/2021/ND-CP amending and supplementing a number of articles of Decree No. 61/2018/ND-CP aims to fully and promptly institutionalize the policies and orientations in the Party's Documents and Resolutions, the Conclusions of the Politburo, the Secretariat, the provisions of the Constitution, the Law on Organization of Local Government (amended) on reorganizing administrative units at all levels, building a two-level local government; amending and supplementing regulations on implementing administrative procedures regardless of administrative boundaries within the provincial level.
Accordingly, the draft Decree stipulates the implementation of the one-stop and inter-connected one-stop mechanism in handling administrative procedures at the One-stop Departments of ministries, branches, and provincial and commune-level public administrative service centers for organizations and individuals.
Applicable subjects include: State administrative agencies related to handling administrative procedures under the one-stop, one-stop mechanism at the One-stop Department of ministries, branches, Public Administration Service Centers at provincial and communal levels; cadres, civil servants, public employees, staff or specialized agencies with authority to handle administrative procedures; organizations and individuals with requests to handle administrative procedures and related organizations and individuals.
The draft Decree inherits 19 articles, amends, supplements, and abolishes the contents of 22 articles (amending over 50% of the total number of articles), focusing on the following contents: (1) amending and supplementing regulations related to the organization and operation of provincial-level public administrative service centers and commune-level public administrative service centers, abolishing regulations on district-level One-Stop Departments; (2) adjusting regulations on receiving, processing records, and returning results of administrative procedure settlement to carry out administrative procedures regardless of administrative boundaries within the province; (3) amending and supplementing regulations on the National Public Service Portal and the Information System for handling administrative procedures at the ministry and provincial levels.
Revised and improved content
The draft amends and completes regulations on provincial-level Public Administration Service Centers, including organizational models, additional tasks, and adjustments to regulations on employees in the direction of allowing the signing of labor contracts appropriate to job positions.
Amend and complete the regulations on functions, tasks and powers of the Public Administration Service Center at the commune level to meet new requirements on receiving administrative procedures regardless of administrative boundaries within the province, advising on the implementation of administrative procedure control and digital transformation tasks for the People's Committee at the commune level.
Amend in the direction of simplifying the process and procedures for receiving, processing and returning results of administrative procedures regardless of administrative boundaries within the provincial level.
At the same time, amend and complete the regulations on the National Public Service Portal, which is a system built and operated at the National Data Center and is moving towards becoming a single "One-Stop Shop", adjusting the regulations on the Information System for handling administrative procedures in the direction of not maintaining the Public Service Portal at the ministerial and provincial levels in accordance with the instructions in the Conclusion Notice No. 14-TB/TGV dated April 21, 2025 of the Working Group assisting the Central Steering Committee on Science , Technology, Innovation and Digital Transformation and Resolution No. 175/NQ-CP.
Supplementing transitional provisions for localities that are piloting the model of one-level public administrative service centers as administrative agencies under the provincial People's Committees to continue the pilot.
Contents of removal, reduction and simplification of administrative procedures
According to the orientation on building a two-level local government in the draft revised Law on Organization of Local Government, there will be no more intermediate administrative units (district level). Therefore, the draft Decree removes the regulation on the District-level Reception and Result Delivery Department.
The draft Decree clearly stipulates administrative procedures. The implementation of the provisions in the Decree facilitates people and businesses in carrying out administrative procedures through the One-Stop Department, the Public Administration Service Center at the provincial and communal levels and at the National Public Service Portal, ensuring improved service quality and the ability to monitor the handling of administrative procedures.
