Dong Nai Department of Health has issued Official Dispatch No. 2912/SYT-ATTP reporting to Dong Nai Provincial People's Committee on the progress of inspection, verification and clarification of information on advertising of the product "Nestlé Milo Barley Milk Supplement" of Nestlé Vietnam Limited Liability Company (located in Bien Hoa, Dong Nai).
According to Dong Nai Department of Health , regarding the process of handling the case, immediately upon receiving information for handling, the Department of Health determined that this was a rather complicated case, involving many sectors, and subject to the impact of many specialized laws: Law on Food Safety, Law on Product and Goods Quality, Law on Advertising, Law on Technical Standards and Regulations, Law on Protection of Consumer Rights.
To ensure objectivity in the process of handling the case and promote responsibility in inter-sectoral coordination, the Department of Health has established an inter-sectoral inspection team in coordination with the Department of Investigation Police on crimes of corruption, economy , smuggling, and environment (PC 03 - Dong Nai Provincial Police), the Department of Justice, the Department of Science and Technology, the Department of Culture, Sports and Tourism, and the Market Management Department of Dong Nai Province to conduct inspections, verifications, and clarifications of signs of violations by enterprises.
The case was transferred by the Department of Health to the police investigation agency for verification, clarification and handling according to the provisions of law on the basis of agreement between the Inspection Team and the representative of the Department of Health: Nestlé Vietnam Limited Liability Company has shown signs of "deceiving or confusing consumers by providing false, incomplete, and inaccurate information about one of the contents specified in Point a, Clause 1, Article 10 of the Law on Protection of Consumer Rights."
During the inspection, the inspection team focused on clarifying the information reflected and the direction of the Food Safety Department regarding the advertisement of the product "Nestlé Milo Barley Milk Supplement" of Nestlé Vietnam Limited Liability Company.
In addition, the Inspection Team took samples of the product "Nestlé Milo Barley Milk Supplement" to evaluate the safety and quality indicators of the product.
On May 28, 2025, the Technical Center for Standards, Metrology and Quality 3 returned test result number KT3-03213BTP5 for the sample "Nestlé Milo Barley Milk Supplement", the test result "the product has safety indicators and quality indicators consistent with the product self-declaration profile"./.
