Hanoi speaks out about thousands of HH Linh Dam apartments that have not had red books for nearly 10 years

(Dan Tri) - The Hanoi People's Committee has just responded to voters' petitions about the fact that the apartments in the HH Linh Dam apartment complex (Hoang Mai district) and the 16 Nguyen Thai Hoc apartment complex (Ha Dong district) have not yet been granted red books.


Voters in Hanoi have continued to request the Hanoi People's Committee to pay attention to and direct the resolution of difficulties and problems to soon issue certificates of house ownership and land use rights (pink books) to households at the HH Linh Dam apartment complex, Hoang Liet ward, Hoang Mai district.

Hanoi People's Committee said that the project to build a mixed-use commercial service building, office for lease and high-rise housing HH1, HH2, HH3, HH4 on land lot CC6 Linh Dam is invested or co-invested by Dien Bien Province Construction Private Enterprise No. 1 and Bemes Production, Import-Export Joint Stock Company.

The granting of certificates to households in the Linh Dam HH area has not been resolved because the investor has not completed the project's legal documents and sent them to the Department of Natural Resources and Environment. The City People's Committee has assigned the Department of Natural Resources and Environment to preside over and coordinate with the Department of Construction and the Hoang Mai District People's Committee to resolve this issue.

According to the inspection conclusion of the Hanoi City Inspectorate, the HH Linh Dam apartment complex project was only allowed to build 27 floors, but the investor built 36 floors for the HH4 buildings and 41 floors for the HH1, HH2, HH3 buildings, exceeding the approved planning by 9 - 14 floors. The HH Linh Dam apartment complex has about 10,000 apartments and more than 40,000 residents.

The project has been in operation since 2015, however, nearly 10 years have passed and the project has not yet been granted a pink book due to violations, causing public outrage.

Regarding the issue of granting red books, the Hanoi People's Committee also responded to voters' petitions to direct departments and branches to urge the investor of the apartment building at 16 Nguyen Thai Hoc in Ha Dong district to fully fulfill financial obligations to grant property ownership certificates to residents and to have strict sanctions to deal with investors who delay in doing so.

Hanoi People's Committee said that according to Official Dispatch No. 4320 dated August 2022 of the Department of Finance - Ministry of National Defense , Duyen Hai Corporation has fully paid the land use fee of more than 36.6 billion VND according to Official Dispatch No. 5437 dated August 6, 2015 of the City People's Committee into the temporary account of the Ministry of National Defense.

Based on the monitoring database at the tax authority, the Hanoi Tax Department did not receive any records or documents from the Department of Finance - Ministry of National Defense regarding the identification of units that paid land use fees late and requested the Tax Department to issue a notice of late payment.

Therefore, the Hanoi People's Committee recommends that after the investor completes its financial obligations as prescribed by law, home buyers need to coordinate with the investor to prepare a dossier for granting a certificate according to the provisions of Decree 101/2024 of the Government on basic land survey, land registration, registration, granting of land use right certificates, ownership of assets attached to land and land information system.
