Leaders of Hai An commune, Hai Lang district admitted that they have encountered many difficulties in land management due to the complicated situation of illegal construction of houses and structures in the area affected by the My Thuy port project. Although the commune has actively promoted and encouraged people to understand the regulations, many people have ignored them.

Record dozens of cases

Hai An Commune is located in the Southeast Quang Tri Economic Zone, currently implementing Phase 2 and 3 of the My Thuy Port Project. Recently, the situation of illegal construction of houses and structures in the area affected by the My Thuy Port Project has been complicated. The reason is that many households urgently need housing while waiting to be relocated to the resettlement area.

For example, the case of Mr. Do Hung Viet in My Thuy village, Hai An commune. Mr. Viet's family has just completed the foundation of a one-story house of about 50 square meters due to the need for housing for his children and grandchildren. Mr. Viet let his family's old house, built 30 years ago, be degraded, cracked and cramped, and located less than 500 meters from the coast. The constant worry before each storm season made him agree to build a new house to live in, despite the government's propaganda that illegal construction has the risk of not being compensated.

“We do not know the specific time for land clearance, and do not know which year we will move to the resettlement area to build a solid house to stabilize our lives. Meanwhile, the urgent need for housing forced the family to build this new house even though we know it is against the regulations,” said Mr. Viet.

Through research, in My Thuy village there are many cases like Mr. Viet's family, the urgent need for housing while not knowing exactly when to receive compensation makes them accept illegal construction to improve their quality of life.

Acting Chairman of Hai An Commune Dang Xuan Thanh said that the commune has recorded 60 households building houses and other structures in violation of regulations. In the first 4 months of 2025 alone, 49 cases were recorded, including 18 cases in phase 1 of the My Thuy port expansion. “Some households have a real need for housing, but there is still the idea of ​​wanting to take advantage of the compensation policy by building more lakes, planting trees or building houses,” Mr. Thanh said.

Mr. Thanh also admitted that the commune faced many difficulties in land management due to illegal housing construction. Although the commune actively promoted and encouraged people to understand the regulations, many people ignored them.

Worry about difficulties in land clearance later, worry about disadvantaged people

According to regulations, all houses and constructions in the area affected by the My Thuy port project must apply for a construction permit. However, because the houses are located in the port construction project, the construction permit issued clearly states that the construction can only exist for a maximum of 5 years. At the same time, people must demolish the construction themselves and cannot claim compensation when the state implements the planning. Because of the above two regulations, many people ignore the application for a construction permit.

Acting Chairman of Hai An Commune Dang Xuan Thanh said that during the period before land acquisition, people's construction must comply with the law and have permits. The commune has asked the district People's Committee to consider handling violations that exceed the commune's authority. "We are concerned about difficulties in site clearance in the future, and we are also worried about people suffering losses," Mr. Thanh shared.

The People's Committee of Hai An commune has proposed the People's Committee of Hai Lang district and relevant agencies to speed up the progress of the additional phase 1 land and property inventory. At the same time, it requested specialized agencies to coordinate to thoroughly handle cases of construction and expansion beyond the authority of the commune level. In addition, it requested the police to get involved in grasping the situation and coordinate in handling cases showing signs of taking advantage of the land clearance policy.

Hai Lang District People's Committee is conducting a survey to prepare a dossier for land clearance in phase 1 of the expansion. At the same time, it is requested that the investor speed up the progress of measurement and ownership to soon submit to the District People's Committee to issue a notice of land recovery in phases 2 and 3 of the project, striving to complete the land recovery notice procedure in June 2025.

Regarding land management and construction order, Hai Lang district requested the People's Committee of Hai An commune to promptly inspect and handle cases of illegal housing construction according to its authority; for cases beyond its authority, the records must be sent to the specialized department for final handling. Hai An commune is determined to take action so that from now on there will be no more cases of illegal housing construction in the area.

It can be seen that the situation of illegal construction of houses and works in the area affected by the My Thuy port project is complicated, not only causing difficulties for local authorities in clearing the land later but also directly affecting the lives of people. Therefore, authorities at all levels need to promptly implement solutions to resolve this situation.
