Improving the legal framework for the Security Industry Development Investment Fund.

On the afternoon of November 17th, the National Assembly held a plenary session to discuss the draft Law amending and supplementing a number of articles of the Law on National Defense and Security Industry and Industrial Mobilization.

During the plenary session, National Assembly delegates highly appreciated the drafting agency's efforts in perfecting the legal framework for the defense and security industry, meeting the requirements and tasks of protecting the Fatherland in the new situation. This amendment aims to ensure the law, once enacted, is highly feasible, clearly defines responsibilities and distinctions between the defense and security sectors, and creates incentives for businesses to participate in the national defense and security industry value chain.

Many delegates agreed with the Government's proposal to establish a National Security Industry Complex. The addition of these regulations aims to institutionalize the Politburo's guiding viewpoint in Conclusion No. 108 on the formation of a State-led and directed National Security Industry Complex, with core industrial facilities under the Ministry of Public Security as the nucleus, and the participation of organizations and enterprises inside and outside the People's Public Security.

Speaking in the assembly hall, delegate Duong Khac Mai (Lam Dong) suggested that the functions and tasks of the National Security Industry Complex should be reviewed based on and updated strategic orientations and policies for the development of science, technology, and innovation as stipulated in the Law on Science, Technology, and Innovation, such as: mastering and commercializing technology; expanding international cooperation and actively participating in the global technology value chain; implementing research cooperation projects with foreign countries to access and master technology... Along with that, a review is needed to ensure the similarity between the National Security Industry Complex and the National Defense Industry Complex.

Another issue that many delegates commented on was the separation of the Defense and Security Industry Fund to establish a Defense Industry Fund and a Security Industry Development Investment Fund, in order to help the Ministry of National Defense and the Ministry of Public Security, according to their functions and tasks, to provide more accurate and practical guidance and direction.

However, to further refine this regulation, delegates proposed a thorough review of the expenditure tasks of the Security Industry Development Investment Fund to ensure there is no overlap with existing funds such as the National Venture Capital Fund and the Science, Technology and Innovation Development Fund as stipulated in the Law on Science, Technology and Innovation.

Representative Trinh Xuan An (Dong Nai) agreed with the addition of regulations on the Security Industry Development Investment Fund and the National Security Industry Complex in the draft law; however, he argued that establishing and regulating both the National Defense Industry Fund and the Security Industry Development Investment Fund as non-budgetary state financial funds is inappropriate. It is necessary to define these as two special state financial funds.

"Essentially, both of these Funds are supported by the state budget, but what is very special is that their functions and tasks are completely different from other non-budgetary state financial funds. These are special, urgent tasks, linked to national defense and security, with a high degree of confidentiality. Therefore, these two Funds should not be included in the same 'basket' as other non-budgetary state financial funds," the representative emphasized, suggesting that they should be classified as two special state financial funds.

According to delegate Trinh Xuan An, if the Security Industry Development Investment Fund is allowed to conduct investment activities, then the Defense Industry Fund should also be allowed to conduct investment activities, so that the two Funds have similar characteristics.

Speaking to clarify the issues raised by National Assembly deputies, on behalf of the drafting agency, General Luong Tam Quang, Minister of Public Security, stated that the drafting committee will carefully study and incorporate as much feedback as possible to revise and finalize the draft Law amending and supplementing a number of articles of the Law on National Defense and Security Industry and Industrial Mobilization, ensuring its quality and feasibility.

Regarding the National Security Industry Complex, the Minister stated that the product groups listed in the draft law are key product groups, specifically identified by competent authorities, requiring the National Security Industry Complex to focus its investment and development efforts. This is a mechanism to require and commission these complexes to research and develop products and services in line with the country's development vision. The regulation of product and service groups and the functions and tasks of the National Security Industry Complex aims to affirm the distinction between the National Security Industry Complex and the Defense Industry Complex; while also ensuring flexibility in the process of building and developing the security industry. The Government has proposed assigning the Minister of Public Security the authority to specify the list of specific products and services belonging to these product and service groups.

Regarding the Security Industry Development Fund, the Minister of Public Security emphasized the necessity of a non-budgetary state financial fund mechanism to serve the task. Using a single fund for both the defense and security industries leads to difficulties in management. To promptly institutionalize the Politburo's directive on building and developing the security industry, and to address practical difficulties and obstacles, separating the Defense and Security Industry Fund into two independent funds is the optimal solution, avoiding overlap and duplication in both the fund formation mechanism and fund utilization.

Also during the session, the National Assembly discussed in the plenary hall the draft Law amending and supplementing a number of articles of 10 laws related to security and order. The delegates agreed on the promulgation of the Law amending and supplementing a number of articles of 10 laws related to security and order to align with the results of the reorganization of the two-level local government apparatus and the breakthrough policy of developing science, technology, innovation, and digital transformation.
