
Discussing at the Hall, National Assembly delegates highly appreciated the efforts of the drafting agency in perfecting the legal framework for the national defense and security industry, meeting the requirements and tasks of protecting the Fatherland in the new situation. The amendments and supplements this time aim to help the Law when promulgated to be highly feasible, ensure clear responsibilities, and demarcate between the two fields of defense and security, while creating motivation for businesses to participate in the national defense and security industry value chain.
Many delegates agreed with the Government's proposal to establish a National Security Industrial Complex. The addition of these regulations aims to institutionalize the Politburo's guiding viewpoint in Conclusion No. 108 on the formation of a National Security Industrial Complex led and oriented by the State, with the core being core industrial establishments under the Ministry of Public Security , and the participation of organizations and enterprises inside and outside the People's Public Security.
Giving his opinion at the meeting, delegate Duong Khac Mai (Lam Dong) suggested that it is necessary to review the functions and tasks of the National Security Industrial Complex on the basis of consulting and updating a number of strategic orientations and policies on science, technology and innovation development stipulated in the Law on Science, Technology and Innovation, such as: mastering and commercializing technology, expanding international cooperation and proactively participating in the global technology value chain; implementing tasks and research cooperation projects with foreign countries to access and master technology... Along with that, it is necessary to review to ensure the similarity between the National Security Industrial Complex and the Defense Industrial Complex.
Another content that many delegates commented on was the separation of the National Defense and Security Industry Fund to establish the National Defense Industry Fund and the Security Industry Development Investment Fund to help the Ministry of National Defense and the Ministry of Public Security have closer and more practical directions and directions according to their functions and tasks.
However, to continue to perfect this regulation, delegates proposed to carefully review the expenditure tasks of the Security Industry Development Investment Fund to ensure that there are no duplicate expenditure tasks with current Funds such as the National Venture Investment Fund, the Science, Technology and Innovation Development Fund according to the provisions of the Law on Science, Technology and Innovation.

Delegate Trinh Xuan An (Dong Nai) agreed with the addition of regulations on the Security Industry Development Investment Fund and the National Security Industry Complex in the draft law; at the same time, he said that it would be inappropriate to establish and regulate the Defense Industry Fund and the Security Industry Development Investment Fund as both non-budgetary state financial funds. It is necessary to determine that these are two special state financial funds.
“The nature of these two Funds is supported by the state budget, but what is very special is that these two Funds have functions and tasks that are completely different from other non-budgetary State Financial Funds. These are special, urgent tasks, linked to national defense and security with high confidentiality. Therefore, these two Funds should not be identified as being in the “basket” with other non-budgetary State Financial Funds” - the delegate emphasized and suggested that these should be identified as two special State Financial Funds.
According to delegate Trinh Xuan An, if the Security Industry Development Investment Fund is allowed to operate, it is also necessary to allow the Defense Industry Fund to operate, so that the two Funds have similar characteristics.
Speaking to clarify the issues raised by National Assembly deputies, on behalf of the drafting agency, Senior General Luong Tam Quang, Minister of Public Security, stated that the Drafting Committee will carefully study and absorb as much as possible to revise and perfect the draft Law amending and supplementing a number of articles of the Law on National Defense Industry, Security and Industrial Mobilization, ensuring quality and feasibility.
Regarding the National Security Industrial Complex, the Minister said that the product groups listed in the draft law are key product groups, specifically identified by competent authorities, requiring the National Security Industrial Complex to focus on investment and development. This is a mechanism to request and order these complexes to research and develop in accordance with the country's development vision. The regulation of product groups, services and functions and tasks of the National Security Industrial Complex aims to affirm the difference between the National Security Industrial Complex and the Defense Industrial Complex; at the same time, to ensure flexibility in the process of building and developing the security industry, the Government has proposed to assign the Minister of Public Security to prescribe the list of specific products and services belonging to this group of products and services.
Regarding the Security Industry Development Investment Fund, the Minister of Public Security emphasized that it is necessary to have a mechanism for the State Financial Fund outside the budget to serve the task. Using a common fund for both the defense industry and the security industry leads to difficulties in management. In order to promptly institutionalize the Politburo's direction on building and developing the security industry, and at the same time remove difficulties and obstacles in practice, separating the Defense and Security Industry Fund into two independent Funds is the optimal solution, avoiding overlaps and duplications for both the fund formation mechanism and the fund's use.
Also during the session, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of 10 laws related to security and order. Delegates agreed to promulgate the Law amending and supplementing a number of articles of 10 laws related to security and order to match the results of the reorganization of the apparatus, two-level local government and the policy of breakthrough development of science, technology, innovation and digital transformation.
