Speaking further at the discussion session, General Luong Tam Quang, Politburo member and Minister of Public Security , on behalf of the drafting agency, respectfully thanked the opinions of the National Assembly deputies, affirming that he would study carefully and absorb to the maximum to revise and perfect the draft law to ensure quality and feasibility.

Regarding the purpose of managing criminal records information, receiving opinions from National Assembly deputies, the Drafting Agency will research and revise the draft law in the direction of managing criminal records and criminal records to help citizens know about their criminal records information to resolve personal administrative procedures, support civil servants and public employees to reduce the requirement for criminal records in personnel management.
Regarding the right to request criminal records and criminal record information, taking into account the opinions of National Assembly deputies, the Drafting Agency will study and revise the draft law in the direction that agencies and organizations are not allowed to request citizens to provide criminal record certificate No. 2 to ensure the reintegration into the community for those who have completed their prison sentences as well as ensure the confidentiality of citizens' rights, while minimizing the widespread request for criminal record certificate No. 2 in the past.

In addition, the draft law has added provisions that state agencies, political organizations, and the Vietnam Fatherland Front Committee can exploit criminal record information upon request, through connecting and sharing the Criminal Record Database and the National Population Database to support the management of civil servants and public employees.
Regarding criminal record form No. 1, No. 2 and electronic criminal record form, taking into account the opinions of National Assembly deputies, the Drafting Agency will study and revise the draft law in the direction that the criminal record information of citizens is updated and displayed on VNeID and is considered an available information field, similar to full name, date of birth... This information is also equivalent to a criminal record form, individuals do not need to request a criminal record form when needed. This information is applied with security technology to prevent forgery and a mechanism to identify electronic forms for agencies and organizations to implement.

Regarding other specific contents, the Minister affirmed that the Drafting Agency will study and absorb the maximum opinions of National Assembly Deputies, and report to the Government to revise the draft law. "Currently, the Ministry of Public Security has completed the National Population Database, and is assigned to be the agency in charge of Project 06, on digital transformation, and is coordinating with ministries, branches, and localities to form a "correct, sufficient, clean, and live" database, with a unified common use. VNeID will fully update all information fields and as soon as possible, when VNeID is complete and synchronized, we will propose to abolish the Law on Judicial Records" - the Minister added.
Previously, National Assembly Deputy Nguyen Minh Tam (Quang Tri) expressed his agreement with the Government's submission, the review report and the initial acceptance and explanation report of the Ministry of Public Security. Regarding the regulations on issuing criminal records and the right to request criminal records, the delegate said that in reality, many agencies and organizations require individuals to issue criminal records No. 2 to prove their criminal record status, apply for jobs, go abroad to work, etc., which is contrary to the provisions of the law. This draft law stipulates that agencies and organizations are not allowed to request citizens to provide criminal records No. 2, which is very reasonable.

To avoid abuse, it is recommended that the Drafting Agency study and remove the provision on issuing criminal record certificate No. 2 in the draft law; proving the criminal record of each individual should only stop at confirming whether or not there is a criminal record...
Appreciating this draft law, National Assembly Deputy Nguyen Hai Nam (Hue City) suggested that criminal record certificate No. 1 should be issued electronically, similar to the model of some countries, or like issuing electronic visas, where people only need to enter a personal information code to have their criminal record confirmed for appointment, recruitment exams, etc. Previously, it took a lot of time to apply. With this form, people only need to enter a password and authenticate their identity, the time is very fast, only taking about 1 day...
