Currently, in the Vietnamese legal system, there is only one document, Decree No. 13/2023/ND-CP, which defines personal data and personal data protection. However, the scope of regulation of the Decree does not cover all areas and is not compatible with the provisions on the right to privacy, personal secrets, and family secrets stated in the 2013 Constitution, along with related provisions stated in a number of current legal documents.
The draft Law on Personal Data Protection is built on the viewpoint of concretizing the spirit of the 2013 Constitution, the Party and State's policies and institutions on recognizing, respecting, protecting personal data, ensuring human rights and basic rights of citizens. The draft Law on Personal Data Protection consists of 7 chapters and 69 articles; regulating the protection of personal data and the responsibility of relevant agencies, organizations and individuals to protect personal data, with 7 contents.
The development of the Law on Personal Data Protection will fully regulate the rights of data subjects, protect personal data, and violations of regulations will be based on the Law to propose appropriate forms and measures of handling.
The Enterprise Law 2020 consists of 10 chapters and 218 articles, was passed by the 14th National Assembly on June 17, 2020 and officially took effect from January 1, 2021. Through the summary of the implementation of the Enterprise Law 2020, in addition to positive results, a number of provisions of the Enterprise Law need to be amended and supplemented to ensure consistency in implementation to suit the new development context.
Specifically: Proposing to amend a number of regulations on the functions and duties of legal representatives, regulations on enterprise branches of the Enterprise Law to ensure consistency with the Civil Code; amend and supplement the content on shares, stocks, and bonds in a direction consistent with the provisions of the Securities Law; explain a number of issues that have not been uniformly understood; amend and supplement the right to establish enterprises, legal status of enterprises; capital contribution, increase and decrease of enterprise capital...
Commenting on the draft laws, delegates all agreed on the necessity of amendments and supplements to meet practical requirements and new development requirements of the economy , ensuring the consistency of the legal system.
The leaders of the Provincial Union of Science and Technology Associations have received and synthesized the delegates' comments on the draft laws to report to the Provincial National Assembly Delegation.
